HomeMy WebLinkAbout2002-01-15; City Council; Resolution 2002-0191 2 3 4 5 6 7 6 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 26 RESOLUTION NO. 2oo*-019 A RESOLUTION OF THE CITY COUNCIL OF THE VACATING AN IRREVOCABLE OFFER OF CITY OF CARLSBAD, CALIFORNIA, SUMMARILY DEDICATION FOR RUSH ROSE STREET AND LEVANTE STREET, STV 99-031CT92-081SDP 98-01 WHEREAS, a request has been made to summarily vacate an irrevocable offer of ledication of Rush Rose Street and Levante Street, west of El Camino Real and north of Calle larcelona Street; and, WHEREAS, Rush Rose Street and Levante Street were irrevocably offered for dedication Ind rejected by the City of Carlsbad, on Final Tract Map CT 92-08, recorded July 10, 2000, as /lap No. 13997; and, WHEREAS, subsequent to approval and recordation of the final map, the La Costa Glen etirement community site development plan (SDP 98-01), was approved by the Planning :ommission and City Council, pursuant to Planning Commission Resolution No. 4447, dated lanuary 6, 1999, and City Council Resolution No. 99-116, dated April 6, 1999; and, WHEREAS, the proposed street vacation was filed to accommodate development of SDP 38-01; and, WHEREAS, the private streets within the retirement community were reviewed by staff and t was determined that the Rush Rose Street and Levante Street irrevocable offers of dedication Ire no longer required for public access or utility purposes; and, WHEREAS, public utility and access easements to serve the project have been obtained )y separate conveyance within La Costa Glen's private streets; and, WHEREAS, utilities are currently being constructed within these easements; and, WHEREAS, the City Engineer has determined that the irrevocable offer of dedication is lot required for present or future street or utility purposes; and, 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the proposed summary street vacation is consistent with the General Plan of le City and the requirements of the Growth Management Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, ialifornia, as follows: 1. The above recitations are true and correct. 2. That pursuant to Division 9, Part 3, Chapter 4, of the California Streets and Highways Code, said irrevocable offer of dedication, more particularly described in Exhibit A, and as shown in Exhibit B for clarity only, be summarily vacated. 3. The City Clerk is directed to record this resolution in the Office of the County Recorder of San Diego County. 4. From the date the resolution is recorded in the County Recorder's office, the area vacated no longer constitutes an irrevocable offer of dedication, nor a public street.
