RESOLUTION NO. 2002-037
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA APPROVING A PLAT MAP TO
ESTABLISH A SEWER REIMBURSEMENT CONNECTION FEE
TO CHESTNUT AVENUE PURSUANT TO THE PROVISIONS OF
FOR THE EL CAMINO REAL SEWER FROM TAMARCK AVENUE
SECTION 13.08.035 OF THE CARLSBAD MUNICIPAL CODE.
WHEREAS, the City Council of the City of Carlsbad has adopted alternative provisions for
bstablishing a sewer main line cost fee in Title 13, Chapter 13.08, Section 13.08.035 of the
:arkbad Municipal Code; and
WHEREAS, the method to distribute the sewer main line cost is established by dividing the
Lost of the sewer project by the number of dwelling units served resulting in a cost per dwelling
Init. This method was used because the sewer pipeline is greater in length than the parcels
ronting the sewer, all parcels receive the same capacity benefit, and not all parcels front
he sewer.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
lalifornia, as follows:
1, That the City will design and construct the El Camino Real Sewer from Tamarack
{venue to Chestnut Avenue project.
2. That the City Engineer has determined that the parcels to be served by said sewer
lipeline project are as listed on Exhibit "A", attached hereto and made a part hereof.
3. That the estimated construction cost for the sewer project is as shown on Exhibit 8.
4. That the City Council has determined that a more equitable fee will result by
ivoking the procedures for establishing sewer pipeline costs as provided in Section 13.08.035 of
le Carlsbad Municipal Code.
5. That the cost share per parcel for El Camino Real Sewer from Tamarack to
:hestnut as shown on Exhibit "C" is hereby approved.

1 6. The City Engineer is authorized to establish sewer reimbursement connection fee
2 for each equivalent dwelling unit to be developed in the benefited area in an amount to be
3 determined by dividing the final estimated project cost of $420,000 by twenty-eight (28) equivalent
4 dwelling units.
5 7. That $420,000 is appropriated from the Sewer Replacement Fund for the project.

7 PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
8 held on the 22nd day of JANUARY , 2002 by the following vote, to wit:
