RESOLUTION NO. 2002-256
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING
AMENDMENT NO. 6 TO AN EXISTING DESIGN
AGREEMENT FOR AVIARA COMMUNITY PARK, CITY
PROJECT NO. 36991
WHEREAS, the City Council of the City of Carlsbad, California, previously
approved a design agreement with P & D Consultants on July 24, 2001 for the design of
Aviara Community Park; and
WHEREAS, CMC Section 3.28.040, c, 7 requires City Council approval of
subsequent amendments whose cumulative value exceeds 25% of the original contract
total up to $100,000 and said Amendment No. 6 exceeds said threshold; and
WHEREAS, the City Council hereby finds, it necessary, desirable, and in the
public interest to approve said Amendment No. 6 to the existing agreement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That Amendment No. 6 to the existing design agreement with P & D Consultants
for Aviara Community Park is hereby approved and the Mayor is authorized to
execute said Amendment. Following the Mayor’s signature of said Amendment
No. 6, the City Clerk is directed to forward copies of the executed Amendment to
the Recreation Department for further processing.

Council held on the 10th day of SEPTEMBER , 2002 by the
