RESOLUTION NO. 2002-316
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA ADOPTING A MITIGATED
NEGATIVE DECLARATION AND MITIGATION MONITORING
AND REPORTING PROGRAM FOR A 53.65 ACRE INDUSTRIAL
AMENDMENT TO AMEND THE LAND USE ELEMENT AND THE
SUBDIVISION AND APPROVING A GENERAL PLAN
OPEN SPACE AND CONSERVATION ELEMENT OF THE
GENERAL PLAN.

CASE NO.: GPA 00-05
WHEREAS, pursuant to the provisions of the Municipal Code, the Planning
Commission did, on September 4, 2002, hold a duly noticed public hearing as prescribed by law
to consider a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program
and General Plan Amendment, and recommended their approval; and
WHEREAS, the City Council of the City of Carlsbad, on the 22nd day of October,
2002, held a duly noticed public hearing to consider said Mitigated Negative Declaration and
Mitigation Monitoring and Reporting Program and General Plan Amendment and at that time
received recommendations, objections, protests, comments of all persons interested in or
opposed to GPA 00-05;
NOW, THEREFORE, the City Council of the City of Carlsbad, California, does
hereby resolve as follows:
1. That the above recitations are true and correct.
2. That the recommendation of the Planning Commission for the approval of the
General Plan Amendment (GPA 00-05) as shown in Planning Commission Resolution No.
5238 is hereby accepted, approved in concept and shall be formally approved with the GPA
Batch No. 3 comprised of GPA 00-05 and GPA 02-02.
Program according to Exhibit "ND" dated January 23, 2002, are adopted as amended by City
3. That the Mitigated Negative Declaration and Mitigation Monitoring and Reporting
Council as follows:
Mitigation Measure Number 2
Prior to approval of final map, applicant shall preserve an additional 2.93 acres of non-native
grassland habitat on site to mitigate impacts to the non-native grassland habitat.

4. That the findings of the Planning Commission Resolutions No. 5237, 5238 and
5239 are incorporated herein by reference and are the findings of the City Council.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Carlsbad on the day of October, 2002, by the following vote, to wit:
