HomeMy WebLinkAbout2003-04-01; City Council; Resolution 2003-0841 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2003-084 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AWARDING THE CONTRACT FOR THE CONSTRUCTION OF POINSETTIA LANE REACH “C” AND DOMESTIC AND RECYCLED WATER TRANSMISSION MAINS, PROJECT NOS. 3673,3585, AND 3675. WHEREAS, the City Council of the City of Carlsbad, California, has previously authorized the advertisement for bids for the construction of Poinsettia Lane Reach “C” and Domestic and Recycled Water Transmission Mains, Project Nos. 3673, 3585, and 3675; and WHEREAS, three sealed bids were received on January 27, 2003 by the City of Carlsbad For the construction of Poinsettia Lane Reach “C” and Domestic and Recycled Water Transmission Mains, Project Nos. 3673, 3585, and 3675; and WHEREAS, all bid documents received from all bidders have been reviewed in detail and the City Council does hereby find that Majich Brothers’ bid was non-responsive because it did not include subcontractor information as required by California Public Contracts Code; therefore, the bid from Majich Brothers is rejected; and WHEREAS, the City Council does hereby find that the lowest responsible and responsive bidder, Orion Construction, did submit a bid in the amount of $2,179,559; and WHEREAS, Subsection 3.28.172(c)(l) of the Carlsbad Municipal Code authorizes the City Manager to approve change orders in the amount equal to the contingency set at the time of the bid award. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the bid of $2,179,559 submitted by Orion Construction for construction of Poinsettia Lane Reach “C” and Domestic and Recycled Water Transmission Mains, Project Nos. 3673, 3585, and 3675, is accepted and the Mayor is hereby authorized and directed to execute a contract therefor. 3. That the award of this contract is contingent upon Orion Construction executing the required contract and submitting the required bonds and insurance policies as described in the sontract within twenty (20) days of adoption of this resolution. The City Manager may grant reasonable extension of time.
