RESOLUTION NO. 2003-108
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING PLANS AND
SPECIFICATIONS AND AUTHORIZING THE CITY CLERK TO
ADVERTISE FOR BIDS FOR THE NORTH AGUA HEDIONDA
INTERCEPTOR SEWER REHABILITATION-EASTERN
SEGMENT, PROJECT NO. 3874-1.
WHEREAS, the City Council of the City of Carlsbad, California, has determined it
necessary, desirable, and in the public interest to rehabilitate the North Agua Hedionda Interceptor
Sewer Rehabilitation-Eastern Segment; and .
WHEREAS, Council originally authorized the advertisement for bids for this project on
August 13, 2002; and two (2) bids were received on October 2, 2002; and
WHEREAS, staff did not recommend that Council award the Project to either bidder
because: The initial apparent low bidder was found to be nonresponsive due to discrepancies
between his bid documents and the information provided by the Contractor’s State Licensing
Board; and the second bid was approximately three (3) times greater than the apparent low bid
and significantly exceeded the engineer’s cost estimate. Both bids have since expired, and need
not be formally rejected by the City Council; and
WHEREAS, the Project’s plans and specifications for the segment of the North Agua
Hedionda Interceptor sewer located between the intersection of Cannon Road and El Camino
Real and the intersection of Park Drive and Kelly Drive have been modified to include the
rehabilitation of an additional fourteen (14) access holes in the North Agua Hedionda Interceptor
sewer which are located primarily in Park Drive between Kelly Drive and Marina; and
WHEREAS, the plans and specifications approved materials have been modified to
encourage a greater number and more competitive bid responses; and
WHEREAS, the plans and specifications for furnishing of all labor, material, tools,
equipment, transportation, and other expenses necessary or incidental for said project have been
prepared and are on file in the Engineering Department of the City of Carlsbad and are
incorporated by reference herein; and

WHEREAS, sufficient Sewer Replacement Funds have been allocated and are available
for this project; and
WHEREAS, the project is exempt from the California Environmental Quality Act pursuant
to CEQA Section 15301 (d).
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the plans, specifications, and contract documents as presented for the
North Agua Hedionda Interceptor Sewer Rehabilitation-Eastern Segment, Project No. 3874-1 are
hereby approved.
3. The City Clerk of the City of Carlsbad is hereby authorized and directed to publish,
in accordance with State law, Notice to Contractors Inviting Bids for the North Agua Hedionda
Interceptor Sewer Rehabilitation-Eastern Segment, Project No. 3874-1.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 22nd day of APRIL , 2003 by the following vote, to wit:
