RESOLUTION NO. 2003-302
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD APPROVING THE 2003 CITY OF CARLSBAD
SEWER MASTER PLAN UPDATE AND APPROVING A CHANGE
TO THE CITY'S SEWER SERVICE CAPACITY FEE.

The City Council of the City of Carlsbad, California, does hereby resolve as follows:
WHEREAS, on December 12, 2001, the City Council of the City of Carlsbad, California
determined it necessary and in the public interest to enter into an agreement with Dudek &
Associates to update to the Carlsbad Sewer Master Plan, Project No. 3870; and
WHEREAS, Dudek & Associates completed the update to the Sewer Master Plan in
accordance with the tasks outlined in its Professional Services Agreement; and
WHEREAS, the 2003 City of Carlsbad Sewer Master Plan Update, incorporated herein by
reference, represents a comprehensive program for the phased and orderly development of
improvements to accommodate the future sewer service needs of the City; and
WHEREAS, the 2003 City of Carlsbad Sewer Master Plan Update identifies individual
zapital improvement projects to construct new facilities, and modify or expand existing facilities
that would be needed to accommodate the demand from future development in the City; and
WHEREAS, in order to generate sufficient revenue to construct the identified facilities, the
Sewer Capacity fee amount needs to be revised to $927.00 per EDU; and
WHEREAS, staff is recommending that the City Council approve the 2003 Sewer Master
Plan Update and revise the Sewer Capacity fee accordingly; and
WHEREAS, the City Council did on the 18th day of November , 2003 hold
3 duly noticed hearing as prescribed by law to consider the proposed Sewer Master Plan Update
md the proposed change in the City's Sewer Capacity fee; and

WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, the City Council considered all factors
relating to the 2003 Sewer Master Plan Update and the proposed change in the City's Sewer
Capacity fee.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as
follows:

That the above recitations are true and correct.
That the City Council of the City of Carlsbad, California hereby approves the 2003
City of Carlsbad Sewer Master Plan Update.

$927.00 per EDU.

That the City Council hereby approves the revision of the Sewer Capacity fee to
That the Sewer Capacity fee change hereby approved shall be effective 60 days
after the adoption of this resolution.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 18th day of November , 2003 by the following vote, to wit:
