HomeMy WebLinkAbout2003-12-16; City Council; Resolution 2003-3311 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2003-331 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING BIDS, AWARDING THE CONTRACT, AND INCREASING THE APPROPRIATION FOR THE CONSTRUCTION OF THE EL CAMINO REAL SEWER, TAMARACK AVENUE TO CHESTNUT AVENUE, PROJECT NO. 3891. WHEREAS, on August 12, 2003, the City Council of the City of Carlsbad, California, approved plans and specifications for construction of the El Camino Real Sewer, Tamarack Avenue to Chestnut Avenue, Project No. 3891 ; and WHEREAS, the City Council of the City of Carlsbad, California, has determined it necessary, desirable, and in the public interest to construct the El Camino Real Sewer, Tamarack 9venue to Chestnut Avenue, Project No. 3891 ; and WHEREAS, nine sealed bids were received on October 8, 2003 by the City of Carlsbad for the construction of El Camino Real Sewer, Tamarack Avenue to Chestnut Avenue, Project No. 3891 ; and WHEREAS, the lowest responsive and responsible bid received to construct Project No. 3891 was submitted by Beador Construction in the amount of $428,300; and WHEREAS, funding for Project 3891 is provided from the Sewer Replacement Fund and $420,000 was appropriated on January 22,2002 by Resolution Number 2002-037; and WHEREAS, to make up the difference between the previously appropriated amount of $420,000 and the estimated project construction cost, the appropriation for Project 3891 shall be ncreased by $30,000 to a total amount of $450,000. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of zarlsbad, California, as follows: 1. 2. That the above recitations are true and correct. That the bid of $428,300 submitted by Beador Construction, is accepted as the owest responsive and responsible bid for the El Camino Real Sewer, Tamarack Avenue to Shestnut Avenue, Project No. 3891, and the Mayor is hereby authorized to execute a contract .herefore. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 3. That an additional $30,000 shall be appropriated from the Sewer Replacement -und for the project increasing the total appropriation to $450,000. 4. That the City Manager is hereby authorized to approve construction change orders .~p to $6,400 for Project No. 3891. 5. That the award of this contract is contingent upon Beador Construction executing he required contract and submitting the required bonds and insurance policies, as described in he contract, within twenty (20) calendar days of adoption of this resolution. The City Manager may jrant reasonable extensions of time. 6. That the final sewer reimbursement connection fee shall be based on the final actual project cost divided by 30 EDU's, using the distribution method shown in Table A, attached iereto and incorporated by this reference. 7. That if additional EDU's are connected above the estimated 30 EDU's, then the esulting cost share per EDU shall be recalculated based on actual EDU's connected and any esulting cost reduction will be reimbursed to those property owners who already paid the higher sewer reimbursement connection fee amount.
