RESOLUTION NO. 2004-053
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING
THE CONSTRUCTION CONTRACT FOR RANCHO SANTA FE
ROAD NORTH, PHASE 2, PROJECT NOS. 3907,3887, AND 3923.
WHEREAS, plans and specifications have been approved by the City Council of the
City of Carlsbad, California, for Rancho Santa Fe Road North, Phase 2, Project Nos. 3907, 3887,
and 3923; and
WHEREAS, the lowest responsible bid received for the Phase 2 work was submitted by
FCI Constructors, Inc. in the amount of $13,782,511; and
WHEREAS, the total estimated costs for the City's contract for construction of the
Rancho Santa Fe Road North, Phase 2, Project Nos. 3907, 3887, and 3923 is $14,200,000,
including $869,000 for the Carlsbad Municipal Water District's recycled water pipelines and
metering vault and $558,000 for the Carlsbad Municipal Water District's potable water pipelines;
and
WHEREAS, $1 8.4 million of Community Facilities District No. 1 and Planned Community
Facilities District No. 2 funds have been appropriated for Phase 2 and the total estimated project
cost is $18.3 million; and
WHEREAS, plans and specifications for the construction of Rancho Santa Fe Road North,
Phase 2, Project Nos. 3907, 3887, and 3923 have been approved by the Federal Bureau of
Reclamation to receive reimbursement for construction costs associated with the recycled water
pipelines that will be constructed in conjunction with the roadway project; and
WHEREAS, based on the City Council approved Environmental Impact Report and
addendums thereto and the approved Habitat Conservation Plan for the road realignment and
widening, there will be no additional significant effect, not analyzed therein, and no new or
additional mitigation measures are required for Phase 2, Project No. 3907, 3887, and 3923;
therefore no new environmental document is required.

NOW, THEREFOREl BE IT RESOLVED, by the City Council of the City of Carlsbad, California, as
follows:

That the above recitations are true and correct.
That the bid of $13,782,511 submitted by FCI Constructors, Inc. for the Rancho
Santa Fe Road North, Phase 2, Project Nos. 3907, 3887 and 3923 is accepted.
3. That the City Manager is hereby authorized to approve construction change orders
for Rancho Santa Fe Road North, Phase 2, up to $2,067,377, or fifteen percent (15%) of the total
contract.
4. That the Mayor of the City of Carlsbad is hereby authorized and directed to execute
a contract for Rancho Santa Fe Road North, Phase 2, Project Nos. 3907, 3887 and 3923 with FCI
Constructors, Inc.
5. That the award of this contract is contingent upon FCI Constructors, Inc. executing
the required contract and submitting the required bonds and insurance policies, as described in
the contract, within twenty (20) days of adoption of this resolution. The City Manager may grant
reasonable extensions of time.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 2nd day of March , 2004 by the following vote, to wit:
