RESOLUTION NO. 2004-104
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING THE CONSTRUCTION OF
SUNNYHILL DRIVE DRAINAGE IMPROVEMENTS, PROJECT NO.
WHEREAS, the construction of Sunnyhill Drive Drainage Improvements has been
completed to the City’s satisfaction by Don Hubbard Construction Company on January 26, 2004;
and
WHEREAS, the formal project Notice of Completion has been prepared; and
WHEREAS, all project costs have been established to date.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the Sunnyhill Drive Drainage Improvements, specifically identified as Project No.
3839, is deemed complete and is hereby accepted by the City Council of the City of Carlsbad.
3. The City Clerk of the City of Carlsbad is hereby authorized and directed to execute
and record the Notice of Completion for the construction of Sunnyhill Drive Drainage
Improvements, Project No. 3839.
4. That the City Clerk is directed to release all bonds on Project No. 3839 in accordance
with State Law and City Ordinances.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 6th day of April , 2004 by the following vote, to wit:
AYES: Council Members Lewis, Finnila, Kulchin, Hall and Packard
