RESOLUTION NO. 2004-120
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING THE TERRACES AT SUNNYCREEK, WIDENING OF EL CAMINO REAL AND IMPROVEMENT OF COLLEGE BLVD. AS COMPLETE, AND
DIRECTING THE CITY MANAGER TO EXECUTE THE
ACCEPTANCE OF PUBLIC IMPROVEMENTS, AND AUTHORIZING
THE RECORDATION OF A NOTICE OF COMPLETION, PROJECT
NO. CT 96-02.
WHEREAS, the construction of the Terraces at Sunnycreek, Widening of El Camino Real
’rom Sta. 373+95 to Sta. 403+51.50 and Improvement of College Blvd. has been completed to the
Zity’s satisfaction by The Terraces at Sunnycreek, LLC, a California Limited Liability Company on
January 26,2004; and
WHEREAS, El Camino Real and College Blvd. meets the criteria of a circulation element
*oadway as defined in the City’s General Plan and Council Policy No. 63; and
WHEREAS, Council Policy No. 63 requires formal City Council acceptance of Circulation
Element roadways into the City’s street system; and
WHEREAS, the formal project Notice of Completion has been prepared.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
Zalifornia, as follows:
1. That the above recitations are true and correct.
2. That the Terraces at Sunnycreek, Widening of El Camino Real from Sta. 373+95 to
Sta. 403+51.50 and Improvement of College Blvd., specifically identified as Project No. CT 96-02
s deemed complete and is hereby accepted by the City Council of the City of Carlsbad.
3. The City Manager of the City of Carlsbad is hereby authorized and directed to execute
:he Acceptance of Public Improvements and the City Clerk is directed to record the Notice of
Zompletion for the Terraces at Sunnycreek, the Widening of El Camino Real and Improvement of
2ollege Blvd., Project No. CT 96-02.

4. That all bonds on the Terraces at Sunnycreek, Widening of El Camino Real and
Improvement of College Blvd., Project No. CT 96-02 be released in accordance with State Law
and City Ordinances.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 13* day of *Pril , 2004 by the following vote, to wit:
