RESOLUTION NO. 2004-221
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING PLANS AND
SPECIFICATIONS AND AUTHORIZING THE CITY CLERK TO
ADVERTISE FOR BIDS FOR COASTAL RAIL TRAIL PHASE I
AND APPROPRIATING FUNDS, PROJECT NO. 3455.
WHEREAS, in 1989, the San Diego Association of Governments (SANDAG) Bicycle
Facilities Coordinating Committee commissioned a study and determined it feasible to construct a
bike path along the railroad right of way between Oceanside Transit Center and the San Diego
Santa Fe Depot for nearly its full length; and
WHEREAS, in 1992, the SANDAG Bicycle Facilities Coordinating Committee sponsored
an lntermodal Surface Transportation Enhancement Act (ISTEA) grant for the development of a
feasibility study evaluating the alignment alternatives and resulting impacts from the possible
construction of a Class I bike path parallel to and within the existing north/south railroad right of
way; and
WHEREAS, the Coastal Rail Trail project is a 42 mile multi-modal bicycle and pedestrian
facility envisioned to be constructed in the existing railroad right of way between the Oceanside
Transit Center and the San Diego Santa Fe Depot; and
WHEREAS, the City of Carlsbad was designated as the lead agency in the 1994-01
Regional Transportation Improvement Program (RTIP) for the development of a feasibility study
for the Coastal Rail Trail; and
WHEREAS, on November 5, 1996, the City of Carlsbad entered into a Memorandum of
Understanding with the cities of Del Mar, Encinitas, Oceanside, San Diego and Solana Beach
along with the San Diego County Transit District (currently North County Transit District) and the
Metropolitan Transit Development Boards for coordinated planning and design of a multi-modal,
non-motorized transportation facility; and
WHEREAS, on April 17, 2001, the City Council approved the Coastal Rail Trail Project
Study Report developed by Transtech Engineers, dated October 2000, for the project from the
Oceanside Transit Center and the San Diego Santa Fe Depot; and
WHEREAS, City of Carlsbad as lead agency adopted a Mitigated Negative Declaration for
the Coastal Rail Trail in the cities of Del Mar, Solana Beach, Encinitas, Carlsbad and Oceanside
[Cities) ; and

WHEREAS, on August 1, 2001, Caltrans and the Federal Highway Administration (FHWA)
determined that the Coastal Rail Trail project does not individually or cumulatively have significant
environmental impact and processed a Categorical Exclusion (CE) as defined by the National
Environmental Protection Act (NEPA); and
WHEREAS, the Cities each authorized individual contracts for the design of the plans,
specifications and estimates for their portion of the Coastal Rail Trail; and
WHEREAS, on September 18, 2001, the City Council authorized entering into an
agreement with Dokken Engineering to perform design engineering services for Phases I and II
for the portion of the Costal Rail Trail in Carlsbad; and
WHEREAS, the City Council of the City of Carlsbad, California, has determined it is in the
public interest to construct the multi-modal pathway located partially in North County Transit
District (NCTD) right-of-way and on City streets for the project; and
WHEREAS, the plans and specifications for furnishing of all labor, materials, tools,
equipment, transportation, and other expenses necessary or incidental to said project have been
prepared and are on file in the Engineering Department of the City of Carlsbad and are
incorporated by reference herein; and
WHEREAS, said project was included in the 2004/2005 Capital Improvement Program;
and
WHEREAS, the City is proceeding with the Phase I construction of the project; and
WHEREAS, all Federal and State funds for design (Phases I and II) and construction
:Phase I) have been appropriated; and
WHEREAS, the remaining TransNet funds approved for the project will be appropriated
Jpon receipt; and
WHEREAS, Air Pollution Control District (APCD) grant funds have been approved and are
lot yet appropriated.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
=alifornia, as follows:
1. That the above recitations are true and correct.

2. That the plans, specifications and contract documents on file in the Engineering
Department of the City of Carlsbad are hereby approved.
3. The City Clerk of the City of Carlsbad is hereby authorized and directed to publish,
in accordance with State law, a Notice to Contractors Inviting Bids for the construction of
the Coastal Rail Trail Phase I, Project No. 3455, in accordance with the plans,
specifications and contract documents referred to herein.
4.
