HomeMy WebLinkAbout2004-07-27; City Council; Resolution 2004-242I 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2004-242 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING THE CONSTRUCTION OF THE COLLEGE BOULEVARD CONSTRUCTION OF THE MlRA MONTE DRIVE PORTION OF PROJECT NO. CT PORTION OF PROJECT NO. CT 83-32, CALAVERA HILLS VILLAGE Q, THE 83-19, CALAVERA HILLS VILLAGE T, AND THE COLLEGE BOULEVARD AND CANNON ROAD PORTION OF CALAVERA PROJECT NO. CT 00-02, CALAVERA HILLS PHASE 11, AS COMPLETE, AND DIRECTING THE CITY MANAGER TO EXECUTE THE RESPECTIVE ACCEPTANCES OF PUBLIC IMPROVEMENTS AND DIRECTING THE CITY CLERK TO RECORD A NOTICE OF COMPLETION ON THE 02, CALAVERA HILLS, PHASE II. COLLEGE BOULEVARD AND CANNON ROAD PORTION OF PROJECT NO. CT 00- WHEREAS, the construction of College Boulevard, as conditioned by the approval of CT 83-32 Calavera Hills Village Q, has been completed to the City’s satisfaction by McMillin Companies, LLC; and WHEREAS, the construction of Mira Monte Drive, as conditioned by the approval of CT 83-19 Calavera Hills Village T, has been completed to the City’s satisfaction by McMillin Companies, LLC; and WHEREAS, the construction of College Boulevard and Cannon Road, as conditioned by the approval of CT 00-02 Calavera Hills Phase 11, has been completed to the City’s satisfaction by Calavera Hills II, LLC; and WHEREAS, College Boulevard and Cannon Road meet the criteria of a circulation element roadway as defined in the City’s General Plan and Council Policy No. 63; and WHEREAS, the formal project Notices of Completion have been recorded on CT 83-32 Calavera Hills Village Q, and CT 83-1 9 Calavera Hills Village T; and WHEREAS, the formal project Notice of Completion has been prepared for CT 00-02, Calavera Hills Phase II, College Boulevard and Cannon Road. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the construction of the public improvements on. College Boulevard, from Carlsbad’s northerly boundary to Carlsbad Village Drive, specifically identified on drawing number 303-2 is deemed complete and is hereby accepted. 3. That the construction of the public improvements on Mira Monte Drive, from 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Carlsbad’s northerly boundary to Foothill Avenue, specifically identified on drawing number 304-7 is deemed complete and is hereby accepted. 4. That the construction of the public improvements on Calavera Hills Phase II, specifically identified as Project No. CT 00-02, as shown on drawing number 390-9 is deemed complete and is hereby accepted. 5. That the City Manager of the City of Carlsbad is hereby authorized and directed to execute the Acceptance of Public Improvements on College Boulevard, from the northerly boundary of Carlsbad to Carlsbad Village Drive. 6. That the matter will be returned to the City Council as soon as practicable after January 1, 2005 with a report and recommendation on the closure of Mira Monte Drive, including the necessary and appropriate studies of the traffic patterns, volumes and levels of service on College Boulevard, the surrounding streets within the neighborhood and including a recommendation on whether or not a stop sign at the intersection of Mira Monte Drive and Foothill Avenue is appropriate. 7. That the City Manager of the City of Carlsbad is hereby authorized and directed to execute the Acceptance of Public Improvements on the College Boulevard and Cannon Road portion of Calavera Hills Phase II, CT 00-02. 8. That the City Clerk of the City of Carlsbad is hereby authorized and directed to execute and record the Notice of Completion for CT 00-02, Calavera Hills Phase It, Agreement No. SEC02074, Drawing Number 390-9. That all bonds on the subject Project will be released in accordance with State Law and City Ordinances. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the 27th day of July ,2004 by the following vote, to wit: AYES: Council Members Lewis, Finnila, Kulchin and Hall NOES: Council Member Packard ATTEST:
