HomeMy WebLinkAbout2004-12-14; City Council; Resolution 2004-4011 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2004-401 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE THIRD GENERAL PLAN AMENDMENT BATCH OF 2004 CONSISTING OF TWO CHANGES TO THE GENERAL PLAN FOR PROJECTS COMMONLY KNOWN AS HOLLY SPRINGS (GPA 00-06), AND CANTARlNl RANCH (GPA 01-09). APPLICANT: CITY OF CARLSBAD CASE NO.: THIRD GENERAL PLAN AMENDMENT OF 2004 WHEREAS, pursuant to Government Code Section 65358 and pursuant to the provisions of the Carlsbad Municipal Code, the Planning Commission, on October 20, 2004, held a duly noticed public hearing for GPA 00-06 and GPA 01-09 as prescribed by law to consider the proposed changes to the General Plan; and WHEREAS, the Planning Commission adopted resolutions No. 5751 and 5757, recommending approval in concept of the proposed changes to the General Plan; and WHEREAS, the City Council on December 7, 2004, held a duly noticed public hearing to consider the Planning Commission’s recommendations and to hear all persons interested in the proposed changes to the General Plan and the related environmental review; and WHEREAS, the City Council of the City of Carlsbad wishes to consolidate the changes to the General Plan as proposed by GPA 00-06 and GPA 01-09 into a single amendment constituting the third General Plan Amendment of 2004. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Carlsbad, California, does hereby resolve as follows: 1. That the above recitations are true and correct. 2. That this is the third of four annual permitted amendments to a mandatory element of the General plan consisting of the following two changes: a. That the Land Use Element and Open Space and Conservation Element of the General Plan for the project commonly known as Holly Springs is amended as shown on attached Exhibit GPA 00-06 and as provided in City Council Resolution No. 2004-388 b. That the Land Use Element and Open Space and Conservation Element of the General Plan for the project commonly known as Cantarini Ranch are amended as shown on attached Exhibit GPA 01-09 and as provided in City Council Resolution No. 2004-387 (on file in the City Clerk’s office).
