HomeMy WebLinkAbout2005-12-13; City Council; Resolution 2005-3611 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2005361 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, REJECTING THE LOW BID AS THE CONTRACT FOR CURB, GUTTER, AND SIDEWALKS, NON-RESPONSIVE AND ACCEPTING BIDS AND AWARDING CONTRACT NO. PWSOG-02STS. WHEREAS, bids have been solicited by the City of Carlsbad, California to replace and repair City curb, gutter, and sidewalk facilities in various locations; and WHEREAS, the bids were received, opened, witnessed and recorded on August 24,2005; and WHEREAS, the lowest bid received was submitted by CH&D Construction in the amount Df $84,921 ; and WHEREAS, the City of Carlsbad requires that the all bids evidence that the bidder have a Jalid contractor’s license and that any bid that does not do so will be rejected as non-responsive; and WHEREAS, CH&D Construction did not possess a valid contractor’s license at the time of Did submittal; and WHEREAS, the lowest responsive bid received was submitted by D.G. Yeager Construction in the amount of $1 15,747; and WHEREAS, City curb, gutter, and sidewalk repairs are necessary to maintain City standards; and WHEREAS, the contract cannot be awarded without City Council approval; and WHEREAS, sufficient funds are available in the Streets Maintenance Budget. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. 2. ?ejected. 3. That the above recitations are true and correct. That the award of this contract is contingent upon D.G. Yeager Construction, Inc., sxecuting the required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty (20) days of adoption of this resolution. The City Manager may grant reasonable extensions of time.
