AND APPROPRIATION OF FUNDS. 6 WHEREAS, the City Council of the City of Carlsbad, California, has determined it 7 necessary, desirable, and in the public interest to construct intersection and traffic signal Q improvements at the El Camino Real/Faraday Avenue intersection and traffic signal improvements 9 at the Faraday Avenue/Orion Street, and Faraday Avenue/Priestly Drive intersections; and 10 11 12 13 20 21 22 23 CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING CONTRACT FOR THE CONSTRUCTION OF THE EL CAMINO REAL/ FARADAY AVENUE INTERSECTION IMPROVEMENTS, FARADAY AVENUE/ORION STREET TRAFFIC SIGNAL, AND FARADAY AVENUE/PRIESTLY DRIVE TRAFFIC SIGNAL, PROJECT NOS. WHEREAS, the project is exempt from the California Environmental Quality Act pursuant to CEQA Section 15061 (b)(3); and WHEREAS, a Notice of Exemption has been filed by the Planning Director in compliance with Section 21152b of the Public Resources Code (California Environmental Quality Act); and WHEREAS, on December 20, 2005, through the adoption of Resolution No. 2005-375, the City Council approved plans and specifications for furnishing of all labor, materials, tools, \ O equipment, transportation, and other expenses necessary or incidental to the El Camino 16 Real/Faraday Avenue Intersection Improvements, Faraday Avenue/Orion Street Traffic Signal, 17 and Faraday Avenue/Priestly Drive Traffic Signal Project, Project Nos. 36071, 36211, and 63041; 18 and 19 WHEREAS, eight (8) sealed bids were received on February 9, 2006 for the project; and WHEREAS, the lowest responsive, responsible bid for the project was submitted by Hillcrest Contracting in the amount of $1,239,141; and WHEREAS, on March 21, 2006, through the adoption of Resolution Nos. 2006-064 and 2006-067, the City Council authorized the acquisition of public street and public utility easements from BTINV, LLC and KW Fund l-Carlsbad 1, LP/Sunrise property associates, LLC, for the intersection improvements at El Camino Real and Faraday Avenue, Project No. 36071; and 25 WHEREAS, additional Traffic Impact Fee funds need to be appropriated in order to 26 construct the ECR/Faraday Avenue Intersection Improvements and the Faraday Avenue/ 27 Orion Street Traffic Signal; and 28 1 2 3 4 5 6 7 8 1. That the above recitations are true and correct. 2. That the bid submitted by Hillcrest Contracting in the amount of $1,239,141 for the9 project, is hereby accepted and the Mayor is here authorized to execute the contract for10 the construction of the El Camino Real/Faraday Avenue Intersection Improvements, 11 Faraday Avenue/Orion Street Traffic Signal, and Faraday Avenue/Priestly Drive Traffic Signal 12 Project, Project Nos. 36071, 36211, and 63041, in accordance with the plans, specifications, and 13 contract documents referred to herein. 14 16 WHEREAS, there are sufficient Traffic Impact Fee funds available for the additional appropriation; and WHEREAS, additional Gas Tax funds need to be appropriated in order to construct the Faraday Avenue/Priestly Traffic Signal; and WHEREAS, there are sufficient Gas Tax funds available for the additional appropriation. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 3. That the Finance Director is hereby authorized to appropriate $144,491 from the 15 Traffic Impact Fee fund for the project. 4. That the Finance Director is hereby authorized to appropriate $93,050 from the 17 Gas Tax fund for the project. 18 5. That the City Manager is hereby authorized to approve construction change orders 19 up to $197,300 for Hillcrest Contracting for the El Camino Real/Faraday Avenue Intersection 20 Improvements, Faraday Avenue/Orion Street Traffic Signal, and Faraday Avenue/Priestly Drive 21 Traffic Signal Project, Project Nos. 36071, 36211, and 63041. 22 /// 23 24 25 26 27 28 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 6. That the award of this contract is contingent upon Hillcrest Contracting executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty (20) calendar days of adoption of this resolution. The City Manager may grant reasonable extensions of time.
