2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, REJECTING ALL BIDS FOR
3 EROSION REPAIRS AND DRAINAGE IMPROVEMENTS,
. LEO CARRILLO RANCH HISTORIC PARK, CITY PROJECT
NO. 45011, AUTHORIZING AND APPROVING PLANS AND
5 SPECIFICATIONS FOR RE-BIDDING THE PROJECT AND
APPROPRIATING ADDITIONAL FUNDS TO THE
6 PROJECT.
7 WHEREAS, the City Council of the City of Carlsbad, California, has previously
8 appropriated funds in the 2005-2006 Capital Improvement Program for the erosion
9 repairs and site drainage improvements at Leo Carrillo Ranch Historic Park, City Project
10 45011, herein after referred to as the "Project"; and
11
WHEREAS, The City Council of the City of Carlsbad has previously adopted
12
Resolution No. 2005-374, approving the plans and specifications and authorizing the
. advertisement for bids for the Project; and
15 WHEREAS, bids were received and opened by the City on April 20, 2006 for the
16 Erosion Repairs and Drainage Improvements, Leo Carrillo Ranch Historic Park, City
17 Project No. 45011; and
18 WHEREAS, the City Council does hereby find it necessary, desirable and in the
19 public interest to reject said construction bids and direct staff to re-bid the
20 aforementioned Project; and

WHEREAS, the plans and specifications for re-bidding the Project are complete
22
and ready for advertisement and are on file in the Recreation Department of the City of
23
Carlsbad; and
25 WHEREAS, additional funds in the amount of $87,000 are required to cover
26 escalating construction costs based on previous bids received and revised Engineer's
27 cost estimate for the Project; and

1 WHEREAS, the City Council of the City of Carlsbad finds it necessary, desirable
2 and in the public interest to proceed with the re-bid for said project at this time; and
WHEREAS, funds are available in the General Capital Construction (GCC) Fund,

in the amount of $87,000 to cover the additional costs for the construction of the needed
5 erosion repairs and drainage improvements for the Project;

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
7
Carlsbad, California, as follows:

9 1. That the above recitations are true and correct.
10 2. That the bids received and opened by the City on April 20, 2006 for the
11 construction of Erosion Repairs and Drainage Improvements, Leo Carrillo
12 Ranch Historic Park, City Project No. 45011, are hereby rejected.

3. That the City Council does hereby direct staff to re-bid for the construction
14
of Erosion Repairs and Drainage Improvements, Leo Carrillo Ranch
15
Historic Park, City Project 45011.16
17 4. That the plans and specifications for the re-bidding of the Project, on file at
18 the office of the Recreation Department of the City of Carlsbad, are
19 approved for the Erosion Repairs and Drainage Improvements, Leo
20 Carrillo Ranch Historic Park, City Project No. 45011, and the City Clerk is
91 authorized and directed to advertise for bids for the Project in accordance
22 with State law.

5. That the City Council does hereby authorize the Finance Director to
24
appropriate additional funds for the Erosion Repairs and Drainage
26 Improvements, Leo Carrillo Ranch Historic Park , City Project 45011, in
27 the amount of $87,000 from the GCC Fund.

of the City of Carlsbad on the 18th day of July, 2006, by the following vote:
