A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, APPROVING THE FINAL MAP FOR
CT 05-06, CASSIA PROFESSIONAL OFFICES, APPROVING THE
4 VACATION OF "A" STREET FOR STV 06-01, AND AUTHORIZING THE
CITY CLERK TO PROCESS THE FINAL MAP FOR RECORDATION.

WHEREAS, Franz-Yut El Camino Real, LLC, has submitted a final map known as
6
CT 05-06, Cassia Professional Offices, to the City of Carlsbad for approval; and
7 WHEREAS, the tentative map of CT 05-06 with conditions, was approved by Planning
o
Commission on November 2, 2005 per PC Resolution No. 5982; and
Q WHEREAS, the City Engineer has determined that said map substantially conforms to
10 said conditionally approved tentative map; and
11 WHEREAS, the applicant filed for a street vacation, and has requested "A" Street as
12 dedicated per document 1998-0201274 on April 9, 1998 be summarily vacated; and
13 WHEREAS, the street vacation has been processed pursuant to the California Streets
14 and Highway Codes, and notices were sent to public utility companies and no objections were
received; andi !D
WHEREAS, the dedication of "A" Street is insufficient to construct Cassia Road as

shown on the Tentative Map; and

WHEREAS, the Developer is dedicating replacement right-of-way, by separate
18 instrument (PR 06-16) necessary to construct Cassia Road; and
19 WHEREAS, the City Engineer has determined that the earlier dedication of "A" Street is
20 no longer required for present or future use and recommends approving the vacation of "A" Street
21 per STV 06-01; and
22 WHEREAS, the conditions of approval for said final map have been completed or
23 secured; and
24 WHEREAS, the final map conforms to the City of Carlsbad General Plan and all
__ requirements of City Codes and Standards.25

1 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
2 California, as follows:
1. That the above recitations are true and correct.
2. That said final map known as CT 05-06, Cassia Professional Offices, which is on
file with the City Engineer and is incorporated herein by reference, is accepted,

3. That the City of Carlsbad hereby vacates all of "A" Street as dedicated per
6
document 1998-0201274 recorded April 9, 1998. The vacation limits are described in the legal
7 description and plat (Exhibit 3), incorporated herein.

4. That the City Clerk is authorized to sign the Certificate of Acceptance on the
9 final map.
10 5. That the City Clerk is authorized to cause the original final map to be recorded in
11 the Office of the County Recorder of San Diego County, State of California.
12 6. That the City Clerk is authorized to release the final map to First American Title
13 Company for recording in the Office of the County Recorder.
