CARLSBAD, CALIFORNIA, ADOPTING A MITIGATED
3 NEGATIVE DECLARATION AND MITIGATION MONITORING
AND REPORTING PROGRAM AND APPROVING A ZONE
4 CHANGE (ZC 05-12) AND A MASTER PLAN AMENDMENT (MP
149 (U)) FOR THE FIRE STATION NO. 6 PROJECT LOCATED
5 ON AND ADJACENT TO A 0.5 ACRE CITY-OWNED PROPERTY
AT 7201 RANCHO SANTA FE ROAD (APN 223-617-24),
6 APPROXIMATELY 0.5 MILE SOUTH OF SAN ELIJO ROAD IN
LOCAL FACILITIES MANAGEMENT ZONE 11.

9 WHEREAS, pursuant to the provisions of the Municipal Code, the Planning
10 Commission did, on August 16, 2006, hold a duly noticed public hearing as prescribed by law to
consider a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program,
12 Zone Change ZC 05-12 to rezone the 0.5 acre property from P-C (Planned Community) to R-1-
13 20,000 (One Family Residential, minimum 20,000 square foot lot size), and Master Plan
14 Amendment MP 149(U) to delete that same property from the La Costa Master Plan and
adopted Planning Commission Resolutions No. 6154, 6155, and 6156 recommending to the
16 City Council that they be adopted or approved; and
17 WHEREAS, the City Council did on the 26th day of September . 2006
18 hold a duly noticed public hearing as prescribed by law to consider the Mitigated Negative
19 Declaration and Mitigation Monitoring and Reporting Program, Zone Change 05-12, and Master
9ftzu Plan Amendment MP 149(U); and
21 WHEREAS, at said public hearing, upon hearing and considering all testimony
22 and arguments, if any, of all persons desiring to be heard, the City Council considered all factors
23 relating to the Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program,
24 Zone Change 05-12, and Master Plan Amendment MP 149(U);

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
3 Carlsbad, California, as follows:
4 1. That all recitations are true and correct.
5 2. That the findings and conditions of the Planning Commission in Planning
Commission Resolutions No. 6154, 6155, and 6156 on file with the City Clerk and made a part
6 hereof by reference, are the findings and conditions of the City Council.
3. That the Mitigated Negative Declaration and Mitigation Monitoring and
Reporting Program are adopted as shown in Planning Commission Resolution No. 6154.

4. That the Zone Change ZC 05-12 and Master Plan Amendment MP
9 149(U) are approved as shown in Planning Commission Resolutions No. 6155 and 6156.
