HomeMy WebLinkAbout2007-02-13; City Council; Resolution 2007-028RESOLUTION NO. 2007-028 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING A CONTRACT FOR THE CONSTRUCTION OF THE 2007 CONCRETE 4 REPLACEMENT PROJECT NO. 6013. 5 WHEREAS, the City Council of the City of Carlsbad, California, has determined it necessary, desirable, and in the public interest to replace damaged concrete in the central area of6 Carlsbad in advance of the 2007 pavement rehabilitation projects; and WHEREAS, the project is exempt from the California Environmental Quality Act pursuant 8 to CEQA Section 15301 Class 1 (c); and 9 WHEREAS, on November 14, 2006, through the adoption of Resolution No. 2006-330, 10 the City Council approved plans and specifications for furnishing of all labor, materials, tools, equipment, transportation, and other expenses necessary or incidental to the 2007 Concrete Replacement Project No. 6013; and 12 WHEREAS, six (6) sealed bids were received on January 9, 2007 for the project; and "1 o0 WHEREAS, the lowest responsive, responsible bid for the project was submitted by 14 D.G. Yeager in the amount of $105,831.50; and 15 WHEREAS, there are sufficient concrete replacement funds available in account number 60131 for construction of the project.16 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 17 California, as follows: 18 1. That the above recitations are true and correct. 19 2. That the bid submitted by D.G. Yeager in the amount of $105,831.50 is hereby 20 accepted and the Mayor is hereby authorized to execute the contract for the construction of the 2007 Concrete Replacement Project No. 6013, in accordance with the plans, specifications, and contract documents referred to herein. 22 3. That the City Manager is hereby authorized to approve construction change 23 orders up to the contingency amount of $25,000 to D.G. Yeager for the 2007 Concrete 24 Replacement Project No. 6013. 25 4. That the award of this contract is contingent upon D.G. Yeager executing the 26 required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty (20) calendar days of adoption of this resolution.
