A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
3 CALIFORNIA, APPROVING FOUR QUITCLAIM DEEDS FOR
RELINQUISHMENT OF ACCESS RIGHTS EASEMENTS OVER LOTS 5, 6,
4 19. AND 20 OF CARLSBAD TRACT NO. CT 98-10. MAP NO. 15013.
5 WHEREAS, Opus West Corporation, A Minnesota Corporation, has submitted a request
6 to quitclaim relinquishment of access rights easements originally dedicated to the City per
7 Carlsbad Tract No. 98-10, Map No. 15013, Lots 5, 6,19, and 20; and
o WHEREAS, said easements were never utilized for the purpose for which they were
granted and are not now, nor are they contemplated to be, needed for relinquishing access rights9
purposes; and

WHEREAS, the City Council of the City of Carlsbad has determined it to be in the public
11
interest to quitclaim said easements; and
12 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
13 California, as follows:
1. That the above recitations are true and correct.
15 2. That the quitclaim deeds conveying a relinquishment of access rights over
16 Lots 5, 6, 19, and 20, Map No. 15013 of Carlsbad Tract No. 98-10, to Opus West Corporation,
17 A Minnesota Corporation, as to Lots 5, 6, 19, and 20, which are on file with the City Clerk and are
incorporated by this reference, are approved.
3. That the Mayor is authorized to execute the deeds and the City Clerk is herebyi y
authorized to release the original Quitclaim Deeds to Opus West Corporation, A Minnesota
Corporation Pulte Home Corporation.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council
of the City of Carlsbad on the 12th day of June. 2007, by the following vote to wit:
