2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND
3 AWARDING A CONTRACT FOR CONSTRUCTION OF PICNIC
SHELTERS AT STAGECOACH AND CALAVERA HILLS
4 COMMUNITY PARKS, CITY PROJECT NO. 39361.

WHEREAS, the City Council of the City of Carlsbad, California has previously
appropriated funds for the construction of a picnic shelter at Stagecoach Community Park; and
WHEREAS, funds have been collected from the construction of a cell site and are
available in the Recreation Department's Operating Budget in the amount of $40,000 for
construction of the picnic shelter at Calavera Hills Community Park; and
WHEREAS, the City Council of the City of Carlsbad has previously adopted Resolution
\2 No. 2007-227, approving the plans and specifications and authorizing the advertisement for
13 bidding for the Project; and
14 WHEREAS, 15 sealed bids were received and opened in public by the City on
15 November 6, 2007 for the Project; and
16 WHEREAS, the lowest responsive, responsible bid has been determined to be that
17 which was submitted by Gulf Engineering and Construction; and
18 WHEREAS, the City Council of the City of Carlsbad, California, has determined it
19 necessary, desirable, and in the public interest to award the contract for the aforementioned
20 Project;
21 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
22 California, as follows:
1. That the above recitations are true and correct.
24 2. Funds have been previously appropriated in the amount of $100,000 for the
25 construction of a picnic shelter at Stagecoach Community Park.

3. Funds have been collected from the construction of a cell site to be used for park
27
improvements at Calavera Hills Community Park and such funds are available in
28
1 the Recreation Department's operating budget in the amount of $40,000 for the
2 construction of a picnic shelter at Calavera Hills Community Park.
3 4. That the bids received and opened by the City on November 6, 2007 for the
4 construction of Picnic Shelters at Stagecoach and Calavera Hills Community
5 Park, City Project No. 39361 are hereby accepted and the lowest responsive,
6 responsible bid received is hereby determined to be that which was submitted by
7 Gulf Engineering and Construction, in the amount of $104,400.
5. That said bid received by the City from Gulf Engineering and Construction, is
9 accepted and is hereby awarded to this company and the Mayor is authorized to
10 execute said contract on behalf of the City.

6. That the City Manager is hereby given the authority to approve construction
12
change orders, singly or in aggregate, for the Project up to the amount not to
13
exceed the project budget.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council
of the City of Carlsbad on the 11th day of December, 2007, by the following vote to wit:
AYES: Council Members Lewis, Kulchin, Hall, Packard and Nygaard
NOES: None
ABSENT: None
