2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING COUNCIL POLICY
3 STATEMENT NO. 65 TO ALLOW THE POSTING OF
4 CAMPAIGN AND OTHER NON-COMMERCIAL SIGNS ON
PUBLIC PROPERTY WITHIN THE CITY 20 DAYS PRIOR
5 TO AN ELECTION
6 WHEREAS, the United States and the State of California Constitution allow a
7 government to impose reasonable time, place and manner restrictions with regard to the
8 placement of signs on public property within the city; and

WHEREAS, the current Council Policy Statement No. 65 relating to signs on
10 public property provides in section 9 for temporary political signs in the public right of
11
way during campaign season; and
12
WHEREAS, No. 3 of that section entitled "Time Period" for display of campaign
and other non-commercial topics on public property within the City is currently
15 designated as only during the period of time 45 days preceding and 10 days following a
16 general, special or primary election ; and
17 WHEREAS, the City Council Policy Statement No. 65 desires to continue
18 allowing posting of campaign signs and other non-commercial signs on public property
19 with a sign permit prior to elections; and
20 WHEREAS, the City Council desires to shorten the period of time in which said
21
signs may be displayed to 20 days preceding a general, special or primary election in
22
order to allow exposure and name recognition to all potential election candidates and
23
issues while limiting the time in which the public will be subjected to the visual clutter
25 associated with such signage.
26 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
27 Carlsbad, California, as follows:
1 1. That the above recitations are true and correct.
2 2. That the Council Policy Statement No. 65 be amended to allow campaign
3 and other non-commercial signs in City right of way to be displayed 20 days
4
preceding a general, special or primary election.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council
of the City of Carlsbad on the 4th day of March, 2008, by the following vote to wit:
AYES: Council Members Lewis, Kulchin and Nygaard.
NOES: COUNCIL MEMBERS HALL AND PACKARD.
ABSENT: NONE
