A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING THE CONSTRUCTION
OF MARIANO (AVIARA PARKWAY), PROJECT NO. CT 97-14
4 AS COMPLETE.
5 WHEREAS, the construction of Mariano (Aviara Parkway), as shown on Drawing No.
6 367-2 has been completed to the City's satisfaction by Standard Pacific Corporation on February
7 10, 2002; and
8 WHEREAS, the formal project Notices of Completion and the Acceptances of Public
9 Improvements have been prepared; and
WHEREAS, Aviara Parkway has been deemed as a circulation element roadway as
11 defined in City of Carlsbad Council Policy Statement No. 63.
12 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
14 1. That the above recitations are true and correct.
15 2. That Mariano (Aviara Parkway) specifically identified as Project No. CT 97-14
16 and Drawing No. 367-2, is deemed complete and is hereby accepted by the City Council of the
17
City of Carlsbad.

3. That the City Manager is authorized and directed to execute the Acceptance of
19
Public Improvements for Mariano (Aviara Parkway), Project No. CT 97-14, Drawing No. 367-2,
20
Agreement No. 778.00.
21
4. That the City Clerk of the City of Carlsbad is hereby authorized and directed to
22
execute and record the Notice of Completion for Mariano (Aviara Parkway), Project No. CT 97-14,
23
Drawing No. 367-2, Agreement No. 778.00.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council
of the City of Carlsbad on the 1st day of April, 2008, by the following vote to wit:
AYES: Council Members Lewis, Kulchin, Hall, Packard and Nygaard.
NOES: None.
ABSENT: None.
