RESOLUTION NO. 2008-104

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, TO APPROVE AND AUTHORIZE
EXECUTION OF AMENDMENT NO. 9 TO PROFESSIONAL SERVICES
4 AGREEMENT WITH WIMMER, YAMADA AND CAUGHEY FOR ALGA
NORTE COMMUNITY PARK. PROJECT NO. 3837 AND 3925.

WHEREAS, on July 8, 2003, City Council approved a professional services agreement
6
with Wimmer, Yamada and Caughey, to provide complete design services for Alga Norte
7
Community Park, Project No. 3837 and 3925; and
8
WHEREAS, Wimmer, Yamada and Caughey completed preparation of plans and
9
specifications for Alga Norte Community Park based on the master plan adopted by Resolution
10 No. 2002-371; and
WHEREAS, plans and specifications were completed and bids were received for
12 construction of Alga Norte Community Park; and
13 WHEREAS, on December 18, 2007, the bids for construction of the Alga Norte
Community Park were rejected by Resolution No. 2007-326; and
15 WHEREAS, on February 26, 2008, Council directed staff to defer the aquatics center's
16 recreational component which included wet play structures, pool slides, and a moving river.; and
17 WHEREAS, staff negotiated Amendment No. 9 with Wimmer, Yamada and Caughey to
18 include: removing the aquatic recreational components, as noted above, and associated
19 infrastructure from the plans and specifications; redesign the previous footprint area planned for
20 the aquatic recreational components; conform the plans and specifications to incorporate the
21 addenda items issued to bidders during the previous bid period for the Alga Norte Community
22 Park; update the project cost estimate; additional bid phase support; preparation of any addenda
23 and other revisions required to respond to bidder questions and comments for a not to exceed
24 amount of $238,493.
25 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
26 California, as follows:
1. That the above recitations are true and correct.

2. That Amendment No. 9 to Professional Services Agreement with Wimmer, Yamada
and Caughey for Alga Norte Community Park is hereby approved.
3. That the Mayor or City Manager of the City of Carlsbad is hereby authorized and
directed to execute Amendment No. 9 to Professional Services Agreement with Wimmer, Yamada
and Caughey for and on behalf of the City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the
City of Carlsbad on the 8tb day of April , 2008, by the
following vote, to wit:
AYES: Council Members Kulcbin, Hall, Packard and Nygaard.
NOES: Council Member Lewis.
ABSENT: None.
