A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, AUTHORIZING THE PUBLIC
WORKS DIRECTOR TO FORMALLY NOTIFY CALTRANS OF
4 THE CITY OF CARLSBAD'S REQUEST TO EXTEND THE
POSTING OF THE WEIGHT LIMIT IN ACCORDANCE WITH
5 STATE LAW

7 WHEREAS, the City of Carlsbad is the owner of the Encinas Creek Bridge ("Bridge") on
8 southbound Carlsbad Boulevard between Palomar Airport Road and Poinsettia Lane; and
9 WHEREAS, the State of California Department of Transportation ("CALTRANS") has
10 recommended a posting of a reduced weight limit as an interim safety measure for said Bridge;
11 and
12 WHEREAS, California Vehicle Code Section 35751 requires that the city council request
13 CALTRANS to hold a public hearing to determine if the maximum weight limits can be reduced
14 on the Bridge.
15 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
16 California, as follows:
1. That the above recitations are true and correct.
1R 2. That the City of Carlsbad Public Works Director is authorized to formally notify

CALTRANS of this action and request CALTRANS undertake, in accordance with
20 State law, procedures to extend the weight limit posting until such time as the
21 Bridge is replaced by the City of Carlsbad.22 ///

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council
of the City of Carlsbad on the 2— day of December. 2008, by the following vote to wit:
AYES: Council Members Lewis, Hall, Packard and Nygaard.
NOES: None.
ABSENT: Council Member Kulchin.
