RESOLUTION NO. 2008-338

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING THE CONSTRUCTION
OF CARLSBAD OAKS NORTH - EL FUERTE,
4 PROJECT NO. CT 97-13 AS COMPLETE.
5 WHEREAS, the construction of Carlsbad Oaks North - El Fuerte, as shown on
6 Drawing No. 415-9E has been completed to the City's satisfaction by Techbilt Construction
7 Corporation on September 29, 2008; and
8 WHEREAS, the formal project Notices of Completion and the Acceptances of Public
Improvements have been prepared; and
10 WHEREAS, El Fuerte Street has been deemed as a circulation element roadway as
defined in City of Carlsbad Council Policy Statement No. 63.
12 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
14 1. That the above recitations are true and correct.
15 2. That Carlsbad Oaks North - El Fuerte, specifically identified as
16 Project No. CT97-13 and Drawing No. 415-9E, is deemed complete and is hereby accepted by
17 the City Council of the City of Carlsbad.

3. That the City Manager is authorized and directed to execute the Acceptance of
19
Public Improvements for Carlsbad Oaks North - El Fuerte, Project No. CT 97-13,
20
Drawing No. 415-9E, Agreement No. SEC05004.
21
4. That the City Clerk of the City of Carlsbad is hereby authorized and directed to
22
execute and record the Notice of Completion for Carlsbad Oaks North - El Fuerte,
23
Project No. CT 97-13, Drawing No. 415-9E, Agreement No. SEC05004.24

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council
of the City of Carlsbad on the 16th day of December, 2008, by the following vote to wit:
AYES: Council Members Lewis, Kulchin, Hall, Packard and Blackburn.
NOES: None.
ABSENT: None.
