CARLSBAD, CALIFORNIA, REJECTING ALL BIDS AND
AUTHORIZING THE CITY CLERK TO RE-ADVERTISE FOR BIDS
FOR THE REPAIR OF PALOMAR AIRPORT ROAD BRIDGE OVER

WHEREAS, the City Council of the City of Carlsbad, California, has determined it
6
necessary, desirable, and in the public interest to Repair Palomar Airport Road Bridge Over
7"
Works-Engineering Department of the City of Carlsbad and are incorporated herein by reference;
and

WHEREAS, funding for said project has already been appropriated from GCC and
12 Proposition 42 Funds in the amount of $1,074,000 to cover all project costs; and
Carlsbad Boulevard, Project No. 4700; and
WHEREAS, the plans and specifications for furnishing all labor, materials, tools,
equipment, transportation, and other incidentals have been prepared and are on file in the Public
WHEREAS, six (6) bids were received on February 11, 2009 for the Repair of Palomar
Airport Road Bridge Over Carlsbad Boulevard, Project No. 4700; and
1(- WHEREAS, the City Council hereby finds it necessary, desirable, and in the public
interest to follow the provisions of California Public Contracts Code, Section 22038, and Municipal

Code Section 3.28.110, whereby the City, in its discretion, will reject all bids and seek new bids for
17 this project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the City rejects all bids received on February 11, 2009 for the Repair of
Palomar Airport Road Bridge Over Carlsbad Boulevard, Project No. 4700.
22 3. That the City Clerk of the City of Carlsbad is hereby authorized and directed to
23 publish, in accordance with State law, a Notice to Contractors Inviting Bids for the Repair of
Palomar Airport Road Bridge Over Carlsbad Boulevard, Project No. 4700, in accordance with the
plans, specifications, and contract documents referred to herein.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council
of the City of Carlsbad on the 10th day of March, 2009, by the following vote to wit:
AYES: Council Members Lewis, Kulchin, Hall, Packard and Blackburn.
NOES: None.
ABSENT: None.
