A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING
THE CONTRACT FOR THE CONSTRUCTION OF THE
4 POINSETTIA COMMUNITY PARK PHASE MB PARKING LOTS,
PROJECT NO. 4504.

WHEREAS, the City Council of the City of Carlsbad, California, has determined it
6
necessary, desirable, and in the public interest to construct two additional parking lots at the
Poinsettia Community Park; and

WHEREAS, on March 10, 2009, through the adoption of Resolution No. 2009-046, the
9
City Council approved the plans and specifications for furnishing of all labor, materials, tools,
10
equipment, transportation, and other expenses necessary or incidental to the construction of the
Poinsettia Community Park Phase MB Parking Lots, Project No. 4504; and
WHEREAS, twenty six (26) sealed bids were received on April 22, 2009 for the project;

WHEREAS, the lowest responsive, responsible bid for the project was submitted by15
Marathon General, Inc. in the amount of $231,946; and16
WHEREAS, staff found a minor mathematical error in the bid that recalculated the bid
. amount to $232,447; andTo
1Q WHEREAS, the new bid amount for Marathon General, Inc. is $232,447; and
20 WHEREAS, funding for said project has been appropriated from the Public Facilities Fee
21 Fund in the 2008/2009 Capital Improvement Program in the amount of $963,400 to cover all
22 project costs and is sufficient; and
23 WHEREAS, the City Council has previously determined that payment of prevailing
24 wages will not be required as part of the construction contract per City of Carlsbad Municipal Code
25 Section 3.28.130;
26 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
27 California, as follows:
28 1 • That the above recitations are true and correct.

2 2. That the discrepancy between the total bid amount and the sum of the unit prices
2 is waived.
3. That the bid amount of $232,447 submitted by Marathon General, Inc. is herby
accepted and the Mayor is hereby authorized to execute a contract with Marathon General, Inc.

for the construction of the Poinsettia Community Park Phase MB Parking Lots, Project No. 4504,

in accordance with plans, specifications, and contract documents referred to herein.
4. That the City Manager is hereby authorized to approve construction change

orders up to $75,000 for Project No. 4504.
° 5. That the award of contract is contingent upon the bidder submitting the lowest
10 responsive bid executing the required contract and submitting the required bonds and insurance
11 policies, as described in the contract, within twenty (20) days of adoption of this resolution. The
12 City Manager may grant reasonable extensions of time.
13 6. That payment of prevailing wages will not be required as part of the construction
14 contract per City of Carlsbad Municipal Code Section 3.28.130.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council
of the City of Carlsbad on the 19th day of May, 2009, by the following vote to wit:
AYES: Council Members Lewis, Hall, Packard and Blackburn.
NOES: None.
ABSENT: Council Member Kulchin.
