HomeMy WebLinkAbout2009-06-02; City Council; Resolution 2009-1291 RESOLUTION NO. 2009-129 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 CARLSBAD, CALIFORNIA, AUTHORIZING THE PUBLIC WORKS DIRECTOR, TO EXECUTE IN THE NAME OF THE CITY 4 OF CARLSBAD ALL NECESSARY FORMS FOR THE PURPOSE OF SECURING PAYMENTS AND TO IMPLEMENT AND CARRY . OUT THE PURPOSES SPECIFIED IN SECTION 14581 (a)(5)(A)0 OF THE CALIFORNIA BEVERAGE CONTAINER RECYCLING AND LITTER REDUCTION ACT AND APPROPRIATION OF6 FUNDS. 7 WHEREAS, the people of the State of California have enacted the California Beverage 8 Container Recycling and Litter Reduction Act that provides funds to cities and counties for 9 beverage container recycling and litter cleanup activities; and WHEREAS, the California Department of Conservation's Division of Recycling has been delegated the responsibility for the administration of the program within the State, setting up 11 necessary procedures for cities and counties or their designees under the program; and 12 WHEREAS, per Section 14581 (a)(5)(A) of the California Beverage Container Recycling 13 and Litter Reduction Act (Division 12.1 of the Public Resources Code, Section 14500 et.seq.), 14 the eligible participant must submit the funding request form by the due date and time in order to 15 request funds from the Department of Conservation's Division of Recycling; and ,0 WHEREAS, the City is entitled to an allocation of $26,955 for fiscal year 2009-2010.To NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 17 California, as follows: 18 1. That the above recitations are true and correct. 19 2. That City Council authorizes the submittal of the Funding Request Form to the 20 Department of Conservation's Division of Recycling. 21 3. That the Public Works Director is hereby authorized and empowered to execute, 22 in the name of the City of Carlsbad, all necessary forms hereto for the purpose of securing payments and to implement and carry out the purposes specified in the Section 14581 (a)(5)(A) of ^O the California Beverage Container Recycling and Litter Reduction Act and provide information 24 regarding this program to the Department of Conservation's Division of Recycling upon request. 2*5 4.
