A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING
THE CONTRACT FOR THE CONSTRUCTION OF THE PALOMAR
4 AIRPORT ROAD WIDENING AT PASEO DEL NORTE,
PROJECT NO. 3811.

WHEREAS, the City Council of the City of Carlsbad, California, has determined it
6
necessary, desirable, and in the public interest to construct one additional westbound through lane
on Palomar Airport Road including an Overhead Caltrans Truss Sign Structure; and
8
WHEREAS, on April 7, 2009, through the adoption of Resolution No. 2009-063, the City
9
Council approved the plans and specifications for furnishing of all labor, materials, tools,
10
equipment, transportation, and other expenses necessary or incidental to the construction of the11
Palomar Airport Road Widening at Paseo Del Norte Project No. 3811; and
WHEREAS, sixteen (16) sealed bids were received on May 20, 2009 for the project; and

WHEREAS, the lowest responsive bid for the project was submitted by Sierra Pacific14
West, Inc. in the amount of $961,240; and15
WHEREAS, funding for said project has been appropriated from the Traffic Impact Fee16
Fund in the amount of $1,676,019 to cover all project costs and is sufficient; and
WHEREAS, the City will be reimbursed by CB Ranch Enterprises in the amount of18
approximately $188,313 in accordance with the reimbursement agreement approved through thei y
20 adoption of Resolution No. 2009-063; and
21 WHEREAS, the City Council has previously determined that payment of prevailing
22 wages will not be required as part of the construction contract per City of Carlsbad Municipal Code
23 Section 3.28.130.
24 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
25 California, as follows:
2g 1. That the above recitations are true and correct.
27 2. That the bid amount of $961,240 submitted by Sierra Pacific West, Inc. is hereby
28 accepted and the Mayor is hereby authorized to execute a contract with Sierra Pacific West, Inc.

1 for the construction of the Palomar Airport Road Widening at Paseo Del Norte, Project No.
2 3811, in accordance with plans, specifications, and contract documents referred to herein.
3 3. That the City Manager is hereby authorized to approve construction change
orders up to $144,500 for Project No. 3811.
4. That the award of contract is contingent upon the lowest responsive bidder,

Sierra Pacific West, Inc. executing the required contract and submitting the required bonds and

insurance policies, as described in the contract, within twenty (20) days of adoption of this
resolution. The City Manager may grant reasonable extensions of time.

5. That payment of prevailing wages will not be required as part of the construction
9 contract per City of Carlsbad Municipal Code Section 3.28.130.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council
of the City of Carlsbad on the 16th day of June, 2009, by the following vote to wit:
AYES: Council Members Lewis, Kulchin, Hall, Packard and Blackburn.
NOES: None.
ABSENT: None.
