HomeMy WebLinkAbout2009-08-18; City Council; Resolution 2009-222RESOLUTION NO. 2009-222 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 CARLSBAD, CALIFORNIA, APPROVING AMENDMENT NO. 1 TO THE CARLSBAD TRANSNET LOCAL STREET 4 IMPROVEMENT PROGRAM OF PROJECTS FOR FISCAL YEARS 2009 THROUGH 2013 5 6 WHEREAS, on November 4, 2004, the voters of San Diego County approved the 7 San Diego Transportation Improvement Program Ordinance and Expenditure Plan (TransNet 8 Extension Ordinance); and 9 WHEREAS, the TransNet Extension Ordinance provides that SANDAG, acting as the 10 Regional Transportation Commission, shall approve a multi-year program of projects submitted 11 by local jurisdictions identifying those transportation projects eligible to use transportation sales 12 tax (TransNet) funds; and WHEREAS, the City of Carlsbad was provided with an estimate of annual TransNet local street and road revenues for Fiscal Years 2009 through 2013; and 15 WHEREAS, the City of Carlsbad has held a clearly noticed public hearing regarding its proposed Amendment No. 1 to the list of projects in accordance with Section 5(A) of the 17 TransNet Ordinance and Rule 7 of the SANDAG Board Policy 31. 18 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 1Q California, as follows: on 1. That the above recitations are true and correct. 2. That pursuant to Section 2(C)(1) of the TransNet Extension Ordinance, the City of 22 Carlsbad certifies that no more than 30 percent of its annual revenues from the TransNet funds 03 shall be spent on maintenance related projects. 24 3. That pursuant to Section 4(E)(3) of the TransNet Extension Ordinance, the City of 25 Carlsbad certifies that all new projects, or major reconstruction projects, funded by TransNet revenues shall accommodate travel by pedestrians and bicyclists, and that any exception to this 27 28 1 requirement permitted under the Ordinance and proposed shall be clearly noticed as part of the 2 City of Carlsbad's public hearing process. 3 4. That pursuant to Section 8 of the TransNet Extension Ordinance, the City of 4 Carlsbad certifies that the required minimum annual level of local discretionary funds to be 5 expended for street and road purposes will be met through the 5-year period consistent with the 6 most recent Maintenance of Effort Requirements adopted by SANDAG. 7 5. That pursuant to Section 9A of the TransNet Extension Ordinance, the City of 8 Carlsbad certifies that it will extract $2,000 from the private sector for each newly constructed 9 residential housing unit in the City of Carlsbad to comply with the provisions of the Regional 10 Transportation Congestion Improvement Program (RTCIP). 11 6. That pursuant to Section 13 of the Transnet Extension Ordinance, the City of 12 Carlsbad certifies that is has established a separate TransNet Improvement Account for 13 TransNet Revenue with interest earned expended only for those purposes for which the funds 14 were allocated. 15 7. That pursuant to Section 18 of the TransNet Extension Ordinance, the City of '® Carlsbad certifies that each project of $250,000 or more will be clearly designated during ' construction with TransNet project funding identification signs. 1ft 8. That the City of Carlsbad does hereby certify that all other applicable provisions of 10 the TransNet Extension Ordinance and the SANDAG Board Policy 31 have been met. 20 9. That the City of Carlsbad agrees to indemnify, hold harmless and defend SANDAG, 21 the San Diego County Regional Transportation Commission, and all officers and employees 22 thereof against all causes of action or claims related to local TransNet funded projects. 23 10.
