HomeMy WebLinkAbout2010-02-23; City Council; Resolution 2010-0341 RESOLUTION NO. 2010-034 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING 3 THE CONTRACT TO TERRA PIPELINE INC. FOR THE CORRUGATED METAL PIPE REPLACEMENT PROGRAM - 4 ALDER AVENUE AND MARRON ROAD STORM DRAINS, PROJECT NO. 6607. 5 6 WHEREAS, on December 1, 2009, the City Council of the City of Carlsbad, through 7 Resolution No. 2009-20,045, has previously authorized to advertize for bids to construct the 8 Corrugate Metal Pipe Replacement Program Alder Avenue and Marron Road Storm Drain 9 Replacements, Project No. 6607and 10 WHEREAS, thirteen (13) sealed bids were received on January 20, 2010, by the City for 11 the construction of said project; and 12 WHEREAS, the lowest responsive and responsible bid to construct said project was 13 submitted by Terra Pipeline Inc. in the amount of $104,715; and 14 WHEREAS, the City Council of the City of Carlsbad, California, has determined it 15 necessary, desirable, and in the public interest to accept bids and award a contract to construct 16 the Corrugated Metal Pipe Replacement Program - Alder Avenue and Marron Road Storm Drains Replacements; and 18 WHEREAS, funding for said project has been appropriated from the Infrastructure 19 Replacement Fund (IRF) to cover all project costs and is sufficient; and 20 WHEREAS, the City Manager is hereby authorized to approve change orders in the 21 cumulative amount equal to the contingency hereby set at fifteen percent (15%) of the contract 22 award. 23 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 25 1. That the above recitations are true and correct. 26 2. That the bid amount of $104,715 submitted by Terra Pipeline Inc. is hereby 27 accepted and the Mayor is hereby authorized to execute a contract with Terra Pipeline Inc. for the 28 1 construction of the Corrugated Metal Pipe Replacement Program - Alder Avenue and Marron 2 Road Storm Drains Replacements, Project No. 6607, in accordance with plans, specifications, and 3 contract documents referred to herein. 4 3. That the award of contract is contingent upon the bidder submitting the lowest 5 responsive bid executing the required contract and submitting the required bonds and insurance 6 policies, as described in the contract, within twenty (20) days of adoption of this resolution.
