WHEREAS, the City Council and Hawthorne Family Trust have agreed to a

purchase price of $2,480,000 for the subject property, not including the cost of appraisal,
11
studies, escrow fees and related expenses, or legal fees.

NOW, THEREFORE, BE IT RESOLVED by the City of Carlsbad, California, as

RESOLUTION NO. 2010-076
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROPRIATING $2,560,000 FROM COMMUNITY FACILITIES
DISTRICT NO. 1 FOR THE ACQUISITION OF APN 213-061-28; AND,
AUTHORIZING THE MAYOR TO EXECUTE ALL DOCUMENTS ASSOCIATED
WHEREAS, the City Council of the City of Carlsbad has determined that it is in the
best interest of the City to acquire APN 213-061-28 and all improvements from the
Hawthorne Family Trust, for a future Public Works Center; and
1. That the above recitations are true and correct.
2. That an appropriation of $2,560,000 is approved for acquisition of the
17 property, including the costs of appraisal, studies, escrow fees and related
expenses, and legal fees.
3. That the City Council hereby makes the finding that acquisition of APN 213-
061-28 is consistent the General Plan of the City of Carlsbad, California.
4. That the Mayor is authorized to execute all documents associated with the
acquisition and transfer of interest in APN 213-061-28 to the City of Carlsbad.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council
of the City of Carlsbad on the 13th day of April, 2010, by the following vote to wit:
AYES: Council Members Lewis, Kulchin, Hall, Packard and Blackburn.
NOES: None.
ABSENT: None.
