HomeMy WebLinkAbout2010-05-11; City Council; Resolution 2010-1051 RESOLUTION NO. 2010-105 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF _ CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND6 AWARDING THE CONTRACT TO ATOM ENGINEERING CONSTRUCTION FOR CONSTRUCTION OF THE LA COSTA 4 AVENUE SUBDRAIN. PROJECT NO. 3681. 5 WHEREAS, the City Council of the City of Carlsbad, California, has determined it 6 necessary, desirable, and in the public interest to construct the La Costa Avenue Subdrain Project 7 No. 3861; and 8 WHEREAS, on February 23, 2010, with resolution 2010-033, the City Council of the City 9 of Carlsbad approved plans and specifications for construction of the La Costa Avenue Subdrain, 10 Project No. 3681; and 11 WHEREAS, eighteen (18) sealed bids were received on April 13, 2010, by the City of 12 Carlsbad for the construction of said project; and 13 WHEREAS, the lowest responsive and responsible bid to construct said project was ^ submitted by Atom Engineering Construction, in the amount of $117,395; and 15 WHEREAS, there are sufficient funds Gas Tax funds available to complete the project; 16 and 17 WHEREAS, subsection 3.28.040(C)(6) of the Carlsbad Municipal Code authorizes the 18 City Manager to approve change orders in the amount equal to the contingency set at the time of 19 project award. 9ft NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 21 California, as follows: 22 1. That the above recitations are true and correct. 23 2. That the low bid of $117,395 submitted by Atom Engineering Construction for the 24 construction of the La Costa Avenue Subdrain, Project No. 3681, is accepted and the Mayor is 25 hereby authorized to execute a contract with Atom Engineering Construction for Project No. 3681. 26 3. That the City Manager is hereby authorized to approve construction change 27 orders up to $46,958. 6 5 6 7 8 9 10 11 12 13 14 15 16 17 18 4. That the award of this contract is contingent upon the bidder submitting the lowest responsible bid executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty (20) days of adoption of this resolution.
