A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, AUTHORIZING THE PURCHASE OF
ONE REPLACEMENT TYPE I STRUCTURE FIRE ENGINE
4 FROM SEAGRAVE, LLC.

WHEREAS, The City of Carlsbad wishes to replace a fire engine which has exceeded its

useful life, and;

WHEREAS, Section 3.128.110(A)(3) of the Carlsbad Municipal Code provides that the
8
City may waive competitive bidding in instances where items are purchased to be compatible
9
with other equipment previously purchased by the City, and;

WHEREAS, the Fiscal Year 2009-2010 appropriation of $420,000 for purchase of a
Type I Structure Fire Engine has been carried over into fiscal Year 2010-201 1 , and;
WHEREAS, Seagrave, LLC has offered to sell the City of Carlsbad one Seagrave fire

engine for a total of $617,123.14
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,15
California, as follows:16
1 j 1 . That the above recitations are true and correct.
18 2. The Council finds that the purchase of a Type I structure fire engine from
19 Seagrave, LLC is required in order to be compatible with existing City equipment,
20 and therefore the competitive bidding requirements of Section 3.28.050 are
21 hereby waived for this purchase under Section 3.28.1 10(A)(3).
22 3. The Finance Director is hereby authorized to appropriate $197,123 for the
23 purchase of one fire engine from the Vehicle Replacement Fund.
24 4. The Purchasing Office is hereby authorized and directed to issue a purchase
25 order to Seagrave, LLC in the amount of $617,123.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council
of the City of Carlsbad on the 24th day of August, 2010, by the following vote to wit:
AYES: Council Members Lewis, Kulchin, Hall, Packard and Blackburn.
NOES: None.
ABSENT: None.
