2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AUTHORIZING THE MAYOR
3 TO EXECUTE THE COOPERATE WORK AGREEMENT
(CWA) EXTENSION FOR THE COASTAL RAIL TRAIL,
4 PROJECT NO. 3455

WHEREAS, the City Council of the City of Carlsbad, California, has determined it is
6
necessary and in the public interest to develop the multi-modal pathway located partially in
7
North County Transit District (NCTD) right-of-way; and
8
WHEREAS, Federal Transportation Equity Act for the 21st Century funds in the amount
9
of $1,694,641 were authorized for the project; and
10
WHEREAS, Federal funds in the amount of $397,479 for the project will expire June 30,
11
2011; and
12
WHEREAS, the Federal funds have a "use-it-or-lose-it" clause; and
13
WHEREAS, staff may not be able to expend all funds by the June 30, 2011 deadline;
14
and
15
WHEREAS, CALTRANS, the local assistance Federal fund manager, will allow a
16
onetime, one-year extension on said funds.

NOW THEREFORE BE IT RESOLVED by the City Council of the City of Carlsbad,
18
California, as follows:

1. That the above recitations are true and correct.
20
2. That the Mayor is hereby authorized to sign the Local Assistance Projects CWA
21
Cycle 8 Budget Authority Lapsing June 30, 2011.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council
of the City of Carlsbad on the 9th day of November, 2010, by the following vote to wit:
AYES: Council Members Lewis, Kulchin, Packard and Blackburn.
NOES: None.
ABSENT: Council Member Hall.
