HomeMy WebLinkAbout2010-12-14; City Council; Resolution 2010-2721 RESOLUTION NO. 2Q1Q-272 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, RECITING THE FACT OF THE 3 GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 2, 2010, DECLARING THE RESULTS AND SUCH OTHER 4 MATTERS AS PROVIDED BY LAW. 5 WHEREAS, a General Municipal Election was held and conducted in the City of Carlsbad, 6 California, on Tuesday, November 2, 2010 as required by law; and, 7 WHEREAS, notice of the election was given in time, form and manner as provided by law; ° that voting precincts were properly established; that election officers were appointed and that in 9 all respects the election was held and conducted and the votes were cast, received and I" canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California relating to the holding of elections in 19 general law cities; and, 13 WHEREAS, the City Council adopted Resolution No. 2010-138, on June 8, 2010, for the 14 purpose of electing a Mayor, two Council Members, a City Treasurer and City Clerk for full terms of four years; and, WHEREAS, the City Council adopted Resolution No. 2010-201, on July 27, 2010, to submit 17 to the voters a question to amend the City Charter; and, 18 WHEREAS the proposed Charter Amendment was known as Proposition "G" on the 19 November ballot; and, 20 WHEREAS, the San Diego County Registrar of Voters canvassed the returns of the election 21 and has certified the results to this City Council, and the results are received and attached as 22 Exhibit "2". 23 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 24 California, as follows: 25 1. That the above recitations are true and correct. 26 2. That the whole number of ballots cast in the city, except "vote by mail" ballots, 27 was 18.860. 28 1 3. That the whole number of "vote by mail" ballots cast in the City was 25.333 making a 2 total of 44.193 ballots cast in the City. 3 4. That the names of the persons voted for at the General Municipal Election are as 4 follows: 5 For Mayor: 6 Matt Hall 7 For Council Members: 8 Farrah Douglas 9 Mark Packard 10 For City Treasurer: 11 Jim Comstock 12 For City Clerk: 13 Lorraine M. Wood 14 5. That the City Council does declare and determine that: l-> Matt Hall was elected as Mayor of the City of Carlsbad for the full term of four years; and, 16 Farrah Douglas and Mark Packard were elected as a Members of the Carlsbad City Council for 17 the full terms of four years; and, 1 810 Jim Comstock was elected as City Treasurer of the City of Carlsbad for the full term of four 19 years; and, 20 Lorraine M. Wood was elected as City Clerk of the City of Carlsbad for the full term of four years. 22 6. That Proposition "G" passed by a majority vote. 23 7. That the City Clerk shall enter on the records of the City Council of the City of Carlsbad, 24 a statement of the results of the election showing: (1) The whole number of ballots cast in the 25 City; (2) The names of the persons voted for; (3) For what office each person was voted for; and 96 (4) The number of votes given at each precinct to each candidate; and, (5) The number of votes 27 for and against the ballot proposition. 28 1 1 8. That the City Clerk shall immediately make and deliver to each of the persons so elected 2 a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk shall also 3 administer to each person elected the Oath of Office prescribed in the Constitution of the State 4 of California and shall have them subscribe to it and file it in the Office of the City Clerk. Each 5 and all of the persons so elected shall then be inducted into the respective office to which they 6 have been elected. 7 9. That the City Clerk shall produce two certified copies of the complete text of the Charter 8 Amendment, one to become a part of permanent city records and one for the County Recorder 9 that includes required certified documents. The City Clerk shall also request the California 10 Secretary of State to accept, file and print as a special charter chapter series of the state 11 statues as applicable. 12 8.
