2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ADOPTING A MEMORANDUM
3 OF UNDERSTANDING BETWEEN REPRESENTATIVES
4 OF MANAGEMENT AND THE CARLSBAD CITY
EMPLOYEES' ASSOCIATION

WHEREAS, representatives of management and the Carlsbad City Employees'
6
Association (CCEA) have met and conferred in good faith pursuant to the Meyers-Milias-
Brown Act regarding wages and other terms and conditions of employment; and8
9 WHEREAS, said representatives have reached agreement which they desire to
10 submit to the City Council for consideration and approval; and
11 WHEREAS, the City Council has determined it to be in the public interest to
12 accept such an agreement in the form of a Memorandum of Understanding (MOU),
marked Exhibit 2 and incorporated by reference herein; and
14 WHEREAS, Resolution No. 2002-362 authorized the City Manager or a designee
15
to implement changes to the City of Carlsbad Deferred Compensation Plan.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
17
Carlsbad, California, as follows:18
19 1. That the above recitations are true and correct.
20 2. That funding for a) the Fiscal Year 2010-11 and Fiscal Year 2011 -12
21 portions of the health insurance contribution adjustments, b) the increase to the safety
22 footwear allowance and c) the cost associated with reporting the value of required

uniforms are included in the respective budgets.
24 3. That the Fiscal Year 2011-12 budget will be adjusted to reflect the net
25
budgetary savings that results from the decrease to the retirement benefits.

1 4. That funding for future year increases described in the MOD will be
2 included in future fiscal year budgets.
5. That the Salary Schedules for CCEA-represented employees as set forth
4 in Attachments A and C of Exhibit 2 are hereby approved.

6. That the City Council directs staff to amend the City's contract with the

California Public Employees' Retirement System (CalPERS) to create a 2nd tier
7
retirement plan for miscellaneous employees at the 2% @ 60 retirement formula8
effective November 27, 2011 or as soon as administratively possible.
10 7. That the City Council directs the City Manager or a designee to amend the
11 City's Deferred Compensation Plan to incorporate the loan provision for CCEA
12 represented participants.
13 8. That the Memorandum of Understanding between the Carlsbad City
14 Employees' Association (CCEA) and the City of Carlsbad is hereby approved and the
15 City Manager is authorized and directed to execute it.
