2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING PLANS AND
3 SPECIFICATIONS, AUTHORIZATION TO RECEIVE BIDS FOR AND
APPROPRIATION OF FUNDS FOR THE OCCIDENTAL
4 INTERCEPTOR SEWER REHABILITATION. PROJECT NO. 5522.
WHEREAS, the Occidental Interceptor Sewer (Sewer) was originally constructed in 1974 under
6 the Occidental-Carlsbad-Leucadia-Encinitas Agreement in Regard to Construction of Sewer Pipeline
7 South from the Encina Water Pollution Control Facility (Agreement); and
8 WHEREAS, allocation of ownership of the Sewer was provided in the Agreement in the
9 following percentages: Leucadia Wastewater District (LWD) 40.3%; City of Carlsbad 40%, and City of
10 Encinitas (Encinitas) 19.7%; and
11 WHEREAS, the Agreement specifies that Carlsbad will manage the maintenance of the Sewer
12 and Carlsbad will bill LWD for 40.3% and Encinitas for 19.7% of the total maintenance cost; and
13 WHEREAS, inspection of the Sewer found defects in the pipeline and manholes in its alignment
14 that are in need of repair; and
15 WHEREAS, City staff has prepared plans and specifications for the repair of approximately 700
1 g lineal feet of 39 inch diameter pipeline and rehabilitate eight manholes in the Sewer; and
17 WHEREAS, the City Council of the City of Carlsbad, California, desires to rehabilitate the
, o Sewer; and1 o
WHEREAS, the plans and specifications for furnishing labor, materials, tools, equipment,i y
transportation, and other expenses necessary or incidental to the Occidental Interceptor Sewer
Rehabilitation, Project No. 5522, have been prepared and are on file in the Utilities Department of the
City of Carlsbad and are incorporated herein by reference; and

WHEREAS, the project is exempt from the California Environmental Quality Act (CEQA) per State
23
CEQA Guidelines Section 15301(b) - minor alteration of existing facilities of public utility services
24
involving negligible or no expansion; and
25
WHEREAS, $533,000 has been appropriated to Project No. 5522 from the Sewer Replacement
26
Fund; and

WHEREAS, the total estimated cost for the project is $849,000; and

1 WHEREAS, staff requests an additional appropriation of $316,000 for Project No. 5522 from the
2 Sewer Replacement Fund; and
3 WHEREAS, the City of Encinitas and the Leucadia Wastewater District have expressed their
4 intent to pay their share; and
5 WHEREAS, the City will invoice LWD and Encinitas for their said percentages of the actual project
cost throughout the construction phase, with final balances to be paid at the completion of the project;
7 and
WHEREAS, payments from LWD and Encinitas will be deposited into the Sewer Replacemento

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:

1. That the above recitations are true and correct.

2. That the plans, specifications, and contract documents for the Occidental Interceptor
13
Sewer Rehabilitation, Project No. 5522, are on file in the Utility Department of the City of Carlsbad and
14
are hereby approved.

3. The City Clerk of the City of Carlsbad is hereby authorized and directed to publish, in
16
accordance with state law, a Notice to Contractors Inviting Bids for the construction of Occidental
17 Interceptor Sewer Rehabilitation, Project No. 5522, in accordance with the plans, specifications, and
18 contract documents referred to herein.
19 4. The Finance Director is authorized to appropriate an additional $316,000 from the
20 Sewer Replacement Fund, to Project No. 5522.

of the City of Carlsbad on the 11th day of October 2011, by the following vote to wit:
AYES: Council Members Hall, Kulchin, Blackburn, Douglas, Packard.
