A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, TO APPROVE INCREASES IN
SOLID WASTE RATES.

5 WHEREAS, the California Constitution, Article XIIID, Section 6, states that local
6 governments must hold a public majority-protest hearing, and notify customers forty-five (45) days
7 in advance of increases in solid waste rates; and
8 WHEREAS, the City of Carlsbad is proposing an increase in solid waste rates; and
9 WHEREAS, in December 2011, Carlsbad residents and property owners were notified
10 by mail of the proposed rate increases (Exhibit 6), thereby complying with the advance notice
11 requirement of forty-five (45) days; and
12 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carisbad,
13 California, as follows:
14 1. That the above recitations are true and correct.
15 2. That the City Council of the City of Carlsbad approves the new trash rates as
'•6 shown in Exhibit 5. The new rates will be effective on July 1, 2012.
