HomeMy WebLinkAbout2012-05-22; City Council; Resolution 2012-118RESOLUTION NO. 2012-118 1 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 CARLSBAD, CALIFORNIA, ADOPTING THE CARLSBAD TRANSNET LOCAL STREET IMPROVEMENT PROGRAM OF 4 PROJECTS FOR FISCAL YEARS 2012-13 THROUGH 2016-17. 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 2. That pursuant to Section 2(C)(1) of the TransNet Extension Ordinance, the City of 23 Carisbad certifies that no more than 30 percent of its annual revenues from the TransNet funds 24 shall be spent on maintenance related projects. 25 3. That pursuant to Section 4(E)(3) of the TransNet Extension Ordinance, the City of 2Q Carisbad certifies that all new projects, or major reconstruction projects, funded by TransNet 27 revenues shall accommodate travel by pedestrians and bicyclists, and that any exception to this 28 WHEREAS, on November 4, 2004, the voters of San Diego County approved the San Diego Transportation Improvement Program Ordinance and Expenditure Plan (TransNet Extension Ordinance); and WHEREAS, the TransNet Extension Ordinance provides that SANDAG, acting as the Regional Transportation Commission, shall approve a multi-year program of projects submitted by local jurisdictions identifying those transportation projects eligible to use transportation sales tax (TransNet) funds; and WHEREAS, the City of Carisbad was provided with an estimate of annual TransNet local improvement revenues for Fiscal Years 2012-13 through 2016-17; and WHEREAS, the City of Carisbad has held a cleariy noticed public meeting with an agenda item that cleariy identified the proposed list of projects prior to approval of the projects by its authorized legislative body in accordance with Section 5(A) of the TransNet Extension Ordinance and Rule 7 ofthe SANDAG Board Policy 31. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carisbad, California, as follows: 1. That the above recitations are true and correct. 1 requirement permitted under the Ordinance and proposed shall be cleariy noticed as part of the 2 City of Carisbad's public hearing process. 3 4. That pursuant to Section 8 of the TransNet Extension Ordinance, the City of 4 Carisbad certifies that the required minimum annual level of local discretionary funds to be 5 expended for street and road purposes will be met throughout the 5-year period consistent with 6 the most recent Maintenance of Effort Requirements adopted by SANDAG. 7 5. That pursuant to Section 9A of the TransNet Extension Ordinance, the City of 8 Carisbad certifies that it will extract $2,000, plus all applicable annual increases, from the private 9 sector for each newly constructed residential housing unit in the City of Carisbad to comply with 10 the provisions of the Regional Transportation Congestion Improvement Program (RTCIP). 6. That pursuant to Section 13 of the Transnet Extension Ordinance, the City of "^2 Carisbad certifies that is has established a separate Transportation Improvement Account for 3 TransNet Revenue with interest earned expended only for those purposes for which the funds ''4 were allocated. 7. That pursuant to Section 18 of the TransNet Extension Ordinance, the City of Carisbad certifies that each project of $250,000 or more will be cleariy designated during construction with TransNet project funding identification signs. 8. That the City of Carisbad does hereby certify that all other applicable provisions of the TransNet Extension Ordinance and the SANDAG Board Policy 31 have been met. 9. That the City of Carisbad agrees to indemnify, hold harmless and defend SANDAG, the San Diego County Regional Transportation Commission, and all officers and employees thereof against all causes of action or claims related to local TransNet funded projects. 10.
