HomeMy WebLinkAbout2012-06-26; City Council; Resolution 2012-1446chibit ^ 1 RESOLUTION NO^012-144 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, REQUESTING THE BOARD OF ^ SUPERVISORS OF THE COUNTY OF SAN DIEGO TO CONSOLIDATE A GENERAL MUNICIPAL ELECTION TO BE HELD IN THE CITY OF CARLSBAD ON TUESDAY, 5 NOVEMBER 6, 2012, WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON THAT DATE PURSUANT TO 6 SECTION 10403 OF THE ELECTIONS CODE 7 WHEREAS, the City Council of the City of Carlsbad called a General Municipal ^ Election to be held on November 6, 2012, for the purpose of the election of two Members of the City Council for full terms of four years; and, WHEREAS, the City Council is submitting to the voters the question relating to an amendment to the City Charter; and WHEREAS, it is desirable that the General Municipal Election be consolidated with the Statewide General election to be held on the same date and that with the city 9 10 11 12 13 14 j5 the precincts, polling places and election officers of the two election be the same, and 16 that the county Registrar of Voters of the County of San Diego canvass the returns of 17 the General Municipal Election and that the election be held in all respects as if there were only one election. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARLSBAD DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That pursuant to the requirements of §10403 of the Elections Code, the Board of Supervisors of the County of San Diego is hereby requested to consent and agree to the consolidation of a General Municipal Election with the Statewide General 18 19 20 21 22 23 24 2^ election on Tuesday, November 6, 2012, for the purpose of the election of two 26 Members of the City Council for full four year terms. 27 SECTION 2. That a measure is to appear on the ballot as follows: 28 5 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Shall Section 502 Retention of Benefits of the Charter of Carlsbad, California be amended to include limiting increases in retirement benefits for miscellaneous employees without an amendment to this section? Text: Section 502 Retention of Benefits. Safety employees hired on or after October 4, 2010 and miscellaneous employees hired after November 27, 2011 (the effective date of the ordinances amending the City's contracts with CalPERS to create a second tier of retirement benefits for safety and miscellaneous employees) shall not have their retirement benefit formulas (commonly known as the 2% at 50 years of age or 2% at 60 year of age formulas respectively) increased without an amendment to this section. The City Council may reduce this formula as provided in state law without an amendment to this section. SECTION 3. That the Registrar of Voters is authorized to canvass the returns of the General Municipal Election. The election shall be held in all respects as if there were only one election, only one form of ballot shall be used. SECTION 4. That the Board of Supervisors is requested to issue instructions to the Registrar of Voters to take any and all steps necessary for the holding of the consolidated election. SECTION 5. That the City of Carlsbad recognizes that additional costs will be incurred by the County by reason of this consolidation and agrees to reimburse the County for any costs. 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 6. That the Assistant City Clerk is hereby directed to file a certified copy of this resolution with the Board of Supervisors and the San Diego County Registrar of Voters. SECTION 7. That the Assistant City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original Resolutions. PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 26^^ day of June, 2012, by the following vote to wit: AYES: NOES: Council Members Hall, Kulchin, Blackburn, Douglas and Packard.
