HomeMy WebLinkAbout2012-09-11; City Council; Resolution 2012-219EXHIBIT 1 6 7 8 9 10 11 12 13 14 15 16 17 18 19 21 23 25 RESOLUTION NO. 2012-219 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING THE REPORT ON THE ENVISION CARLSBAD DRAFT PREFERREDPLAN, AND DIRECTING STAFF TO UTILIZE SAID PLAN IN THE PREPARATION OF THE GENERAL PLAN UPDATE AND PROGRAM ENVIRONMENTAL IMPACT REPORT. CASE NAME: ENVISION CARLSBAD DRAFT PREFERRED PLAN WHEREAS, on July 27, 2010, the Carlsbad City Council adopted Resolution No. 2010-206, initiating Phase 2 of Envision Carlsbad; and WHEREAS, the objective of Envision Carisbad Phase 2 is to update the Carisbad General Plan, Local Coastal Program and Zoning Ordinance; and WHEREAS, the Draft Prefen-ed Plan (Exhibits IA and IB, attached to this resolution) will assist in guiding the preparation of the General Plan update and program environmental report; and WHEREAS, the Draft Prefen-ed Plan reflects the recommendations of the Envision Carisbad Citizens Committee (EC3) and Planning Commission. NOW, THEREFORE, the city Council of the City of Carisbad, California, does hereby resolve as follows: A) That the foregoing recitations are true and con-ect. B) That the City Council accepts the report on the Envision Carisbad Draft Prefen-ed Plan, 20 and the City Council directs staff to utilize said plan in the preparation of the General Plari update and program environmental impact report. C) That also included are the modifications contained in the memorandum dated 22 September 10, 2012 from City Planner Don Neu that state: "that an alternative residential density of R-30 shall be studied as an EIR alternative for the area shown as the "Townhouse Neighborhood" in the Ponto Beachfront Village Vision Plan located within Focus Area 9 of the Draft Prefen-ed Plan"; and C) That also included is the footnote from the letter from Howes Weiler and Associates dated 2^ September 5, 2012 to the city regarding the Excess Dwelling Units Bank that states: 27 "5. EDBU units are not being allocated or resen/ed for the Draft Preferred Plan at this time. This table is for analysis purposes only. When the General Plan update is adopted by City 23 Council, EDBU units will be allocated to effectuate the land use changes adopted with the update, which may differ from those shown on the Draft Preferred Plan. 1.. Alternatives will be analyzed during the preparation of the Program 2 Environmental Impact Report (PEIR); such altematives will include Envision Carisbad Land Use Altematives A (Centers), B (Active Waterfront) and C (Core 3 Focus), and any other altemative that the city determines appropriate to analyze in the PEIR. The PEIR analysis may result in a modification/addition/elimination 4 of residential sites/number of units listed in this table. 5 b. In addition to the residential sites listed in this table, other individual residential projects may be allocated available units from the EDUB at the city's discretion; if 6 such an allocation is made prior to adoption of the General Plan update, the land use changes identified as part ofthe General Plan update shall be analyzed and 7 adjusted as necessary to be consistent with the available units in the EDUB, as well as the city's policy needs and constraints"; and 8 9 10 16 17 18 19 20 21 22 23 D) That also included are following properties shown on Exhibit 9 to the agenda bill, Palomar Oaks West, Basin BJ Parcel. Robertson Ranch PA 22 and the Ponto Village parcel provided that there are satisfactory cost sharing agreements.
