HomeMy WebLinkAbout2012-10-02; City Council; Resolution 2012-23315 16 17 18 19 RESOLUTION NO. 2012-233 1 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING THE CONTRACT TO ALL AMERICAN ASPHALT FOR THE 4 CONSTRUCTION OF THE 2012 PAVEMENT OVERLAY PROJECT NO. 6001-12-OL. 5 6 7 8 9 WHEREAS, the City Council of Carlsbad, California has determined that it is necessary, desirable, and in the public's best interest to construct the 2012 Pavement Overlay Project No. 6001-12-OL; and WHEREAS, on March 27th, 2012, the City Council of the City of Carlsbad approved plans for the construction of the 2012 Pavement Overlay Project No. 6001-12-OL; and 10 WHEREAS, thirteen (13) sealed bids were received on September 13, 2012 by the City 11 of Carlsbad for the construction of the 2012 Pavement Overlay Project No. 6001-12-OL; and 12 WHEREAS, the lowest responsive and responsible bid to construct said project was 13 submitted by All American Asphalt in the amount of $2,453,453; and WHEREAS, there are sufficient funds available in the Pavement Management Program to complete the project; and WHEREAS, subsection 3.28.040(C)(6) of the Carlsbad Municipal Code authorizes the City Manager to approve change orders in the amount equal to the contingency set at the time of project award. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: ^0 1. That the above recitations are true and correct. 21 2. That the low bid of $2,453,453 submitted by All American Asphalt for the 22 construction of the 2012 Pavement Overlay Project No. 6001-12-OL is accepted and the Mayor is 23 hereby authorized to execute a contract for this project. 24 3. That the City Manager is hereby authorized to approve construction change orders up to $171,742. 4. That the award of this contract is contingent upon the bidder submitting the 26 lowest responsible bid executing the required contract and submitting the required bonds and 27 28 1 insurance policies, as described in the contract, within twenty (20) days of adoption of this 2 resolution.
