A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, APPROVING ADMINISTRATIVE
AMENDMENTS TO THE CARLSBAD TRANSNET LOCAL
4 STREET IMPROVEMENT PROGRAM OF PROJECTS FOR
FISCAL YEARS 2012-13 THROUGH 2016-17.

6 WHEREAS, on November 4, 2004, the voters of San Diego County approved the
7 San Diego Transportation Improvement Program Ordinance and Expenditure Plan (TransNet
8 Extension Ordinance); and
9 WHEREAS, the TransNet Extension Ordinance provides that SANDAG, acting as the
10 Regional Transportation Commission, shall approve a multi-year program of projects submitted
11 by local jurisdictions identifying those transportation projects eligible to use transportation sales
12 tax (TransNet) funds; and
13 WHEREAS, the City of Carlsbad was provided with an estimate of annual TransNet local
14 improvement revenues for Fiscal Years 2012-13 through 2016-17; and
15 WHEREAS, the City of Cartsbad has held a clearty noticed public meeting with an
1^ agenda item that clearty identified the proposed list of projects pnor to approval of the projects
17 by its authorized legislative body in accordance with Section 5(A) of the TransNet Extension
^ Ordinance and Rule 7 of the SANDAG Board Policy 31
1^ NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That pursuant to Section 2(C)(1) of the TransNet Extension Ordinance, the City of
Carlsbad certifies that no more than 30 percent of its annual revenues from the TransNet funds
shall be spent on maintenance related projects.
3. That pursuant to Section 4(E)(3) of the TransNet Extension Ordinance, the City of
Cartsbad certifies that all new projects, or major reconstruction projects, funded by TransNet
revenues shall accommodate travel by pedestrians and bicyclists, and that any exception to this

1 requirement permitted under the Ordinance and proposed shall be clearty noticed as part of the
2 City of Carlsbad's public hearing process.
3 4. That pursuant to Section 8 of the TransNet Extension Ordinance, the City of
4 Cartsbad certifies that the required minimum annual level of local discretionary funds to be
5 expended for street and road purposes will be met throughout the 5-year pertod consistent with
6 the most recent Maintenance of Effort Requirements adopted by SANDAG.
7 5. That pursuant to Section 9A of the TransNet Extension Ordinance, the City of
8 Cartsbad certifies that it will extract $2,000, plus all applicable annual increases, from the pnvate
9 sector for each newly constructed residential housing unit in the City of Carlsbad to comply with
10 the provisions ofthe Regional Transportation Congestion Improvement Program (RTCIP).
11 6. That pursuant to Section 13 of the Transnet Extension Ordinance, the City of
12 Cartsbad certifies that is has established a separate Transportation Improvement Account for
13 TransNet Revenue with interest earned expended only for those purposes for which the funds
14 were allocated.
15 7. That pursuant to Section 18 of the TransNet Extension Ordinance, the City of
1^ Cartsbad certifies that each project of $250,000 or more will be clearty designated durtng
''7 construction with TransNet project funding identification signs.
8. That the City of Cartsbad does hereby certify that all other applicable provisions of
the TransNet Extension Ordinance and the SANDAG Board Policy 31 have been met.
9. That the City of Cartsbad agrees to indemnify, hold harmless and defend SANDAG,
the San Diego County Regional Transportation Commission, and all officers and employees
thereof against all causes of action or claims related to local TransNet funded projects.
10. That the administrative amendments to the Cartsbad TransNet Local Street
Improvement Program of Projects for Fiscal Years 2012-13 through 2016-17 attached to this
Resolution as Exhibit A is hereby approved.
