A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, APPROVING A STREET TREE
MAINTENANCE AGREEMENT WITH DEVELOPMENT
4 SOLUTIONS 2LAC, LLC FOR LA COSTA TOWN SQUARE
RESIDENTIAL, PROJECT NO.. GT 08-03.

WHEREAS, the Property Owner, Development Solutions 2LAC, LLC, has executed a
Street Tree Maintenance Agreement for La Costa Town Square, Residential (Agreement), and has
submitted the Agreement to the City of Carlsbad for approval; and
WHEREAS, the Property Owner has submitted this Agreement pursuant to condition 29
of Planning Commission Resolution No. 6582; and
WHEREAS, staff recommends approval of this agreement in that it satisfies condition 29
of Planning Commission Resolution No. 6582; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the Street Tree Maintenance Agreement for La Costa Town Square
^7 Residential, Project No. CT 08-03 between Development Solutions 2LAC, LLC
13 and the City of Carlsbad, which is attached hereto and incorporated herein by
19 reference, is hereby approved and the Mayor is authorized and directed to
20 execute said Agreement.
21 3. That the City Clerk is authorized to forward said Agreement to the Office of the
22 County Recorder for recordation.

PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council of the
City of Carlsbad on the 30*" day of April, 2013, by the following vote to wit:

Council Members Hall, Packard, Wood, Blackburn and Douglas.
None.
ABSENT: None.
