HomeMy WebLinkAbout2013-06-18; City Council; Resolution 2013-155EXHIBIT 1 1 3 9 10 11 12 13 14 15 20 21 22 23 24 25 RESOLUTION NO. 2013-155 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CAUFORNIA APPROVING AN AMENDMENT TO THE VILLAGE MASTER PLAN AND DESIGN MANUAL ("MASTER PLAN") THAT 4 MAKES SELECT CHANGES TO NON-RESIDENTIAL USES, PARKING, AND DESIGN STANDARDS AND MAKES MINOR "HOUSEKEEPING" 5 CHANGES. THE AMENDMENT AFFECTS PROPERTIES WITHIN THE BOUNDARIES OF THE MASTER PLAN THAT ARE OUTSIDE THE ^ COASTAL ZONE EXCEPT FOR THE AMENDMENT'S MINOR 7 HOUSEKEEPING CHANGES, WHICH AFFECT ALL MASTER PLAN PROPERTIES REGARDLESS OF COASTAL ZONE LOCATION. 8 CASE NAME: VILLAGE MASTER PLAN CHANGES CASE NO.: MP 12-01(A) The City Council of the City of Carlsbad, California, does hereby resolve as follows: WHEREAS, pursuant to the provisions of the Municipal Code, the Planning Commission did, on May 15, 2013, hold a duly noticed public hearing as prescribed by law to consider MP 12-01(A), the amendment to the Master Plan, as referenced in Planning Commission Resolution No. 6977; and WHEREAS, the Planning Commission adopted Planning Commission Resolution 16 No. 6977 and recommended to the City Council approval of MP 12-01(A); and 17 WHEREAS, the City Council of the City of Carisbad, on the ^^^^ day of -^^"^ ^ ^ 2013, held a duly noticed public hearing to consider the said amendment to the Master Plan; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, the City Council considered all factors relating to the Master Plan amendment. NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council ofthe City ofCarlsbad as follows: 1. That the above recitations are true and correct. 2^ 2. That the recommendation of the Planning Commission for the approval of MP 12-01{A) is adopted and approved and that the findings of the Planning Commission contained in 27 Planning Commission Resolution No. 6977 on file with the City Clerk and incorporated herein by reference are the findings of the City Council. 28 3. This action is final the date this resolution is adopted by the City Council. The Provisions of Chapter 1.16 ofthe Carlsbad Municipal Code, "Time Umits for Judicial Review" shall apply: "NOTICE TO APPLICANT" The time within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of Carisbad by CaHsbad Municipal Code Chapter 1.16. Any petition or other paper seeking review must be filed in the appropriate court not later than the ninetieth day following the date on which this decision becomes final; however, if within ten days after the decision becomes final a request for the record is filed with a deposit in an amount sufficient to cover the estimated cost or preparation of such record, the time within which such petition may be filed in court is extended to not later than the thirtieth day following the date on which the record is either personally delivered or mailed to the party, or his attorney of record, if he has one. A written request for the preparation of the record of the proceedings shall be filed with the City Clerk, City of Carisbad, 1200 Carlsbad Village Drive, Carisbad, CA. 92008. PASSED, APPROVED AND ADOPTED at a Regular Meeting ofthe City Council ofthe City of Carisbad on the 18'" day of June, 2013, by the following vote to wit: AYES: Council Members Wood, Blackburn and Douglas.
