HomeMy WebLinkAbout2013-11-19; City Council; Resolution 2013-2705 EXHIBIT 1 ^ RESOLUTION NO. 2013-270 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, 3 CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AMENDMENT, SITE DEVELOPMENT PLAN AMENDMENT, AND 4 COASTAL DEVELOPMENT PERMIT TO DEMOLISH 1,240 SQUARE FEET OF EXISTING COOLER AREA, ADD 2,324 SQUARE FEET OF NEW COOLER AREA, AND 1,813 SQUARE FEET OF NEW RECEIVING g AREA TO AN EXISTING 148,231 SQUARE FOOT COSTCO BUILDING LOCATED ON PROPERTY AT 951 PALOMAR AIRPORT ROAD 7 WITHIN THE MELLO II SEGMENT OF THE LOCAL COASTAL PROGRAM AND LOCAL FACILITIES MANAGEMENT ZONE 5. 8 CASE NAME: COSTCO COOLER ADDITION CASE NO.: CUP 90-03(D)/SDP 90-05(H)/CDP 13-05 9 20 The City Council of the City of CaHsbad, California, does hereby resolve as 11 12 13 24 consider Conditional Use Permit Amendment No. CUP 90-03(D), Site Development Plan 15 Amendment SDP 90-05(H), and Coastal Development Permit CDP 13-05; and 16 WHEREAS, the City Council of the City of CaHsbad, on the 19th day ^^^"^^^^ 25 26 27 28 follows: WHEREAS, pursuant to the provisions of the Municipal Code, the Planning Commission did, on October 2, 2013, hold a duly noticed public heanng as prescnbed by law to 2013, held a duly noticed public heanng to consider adoption of Conditional Use Permit Amendment CUP 90-03(D), Site Development Plan Amendment SDP 90-05(H), and Coastal Development Permit CDP 13-05; and WHEREAS, at said public heanng, upon heanng and considenng all testimony and 17 18 19 20 21 22 arguments, if any, of all persons desinng to be heard, the City Council considered all factors 23 relating to the adoption of Conditional Use Permit Amendment CUP 90-03(D), Site 24 Development Plan Amendment SDP 90-05(H), and Coastal Development Permit CDP 13-05. NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 3 1.. 2. That the recommendation of the Planning Commission for the approval 2 of Conditional Use Permit Amendment CUP 90-03(D), Site Development Plan Amendment SDP 90-05(H), and Coastal Development Permit CDP 13-05 is adopted and approved, and that the ^ findings and conditions of the Planning Commission contained in Planning Commission Resolution No. 7015 on file with the City Clerk and incorporated herein by reference, are the findings and conditions ofthe City Council. 11 13 14 15 16 19 20 21 22 23 24 "NOTICE TO APPLICANT" The time within which judicial review ofthis decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of g CaHsbad by CaHsbad Municipal Code Chapter 1.16. Any petition or other paper seeking review must be filed in the appropnate court not later than the ninetieth day following the date on 9 which this decision becomes final; however, if within ten days after the decision becomes final a request for the record is filed with a deposit in an amount sufficient to cover the estimated 10 cost or preparation of such record, the time within which such petition may be filed in court is extended to not later than the thirtieth day following the date on which the record is either personally delivered or mailed to the party, or his attorney of record, if he has one.
