RESOLUTION NO. 2013-281
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, AUTHORIZING THE INTERIM CITY MANAGER TO
EXECUTE A JOINT USE AND COOPERATION AGREEMENT WITH THE
SAN DIEGO COUNTY WATER AUTHORITY
WHEREAS, in 2009 the Carisbad Municipal Water District (CMWD) condemned an
easement on behalf of Poseidon Resources for the desalination pipeline on San Diego Gas and
Electric (SDG&E) property; and
WHEREAS, in 2012 the City of Carisbad (City) condemned an easement for the Vista
Carisbad Sewer Interceptor on SDG&E property that overiaps the easement for the desalination
pipeline; and
WHEREAS, the San Diego County Water Authority (SDCWA) is now partnering with
Poseidon to construct the desalination plant and pipeline; and
WHEREAS, SDCWA has requested that CMWD quitclaim the 2009 easement for the
purposes of constructing the desalination pipeline; and
WHEREAS, there is a potential for conflicts between the two utilities; and
WHEREAS, City staff has negotiated a Joint Use Agreement with SDCWA to minimize the
conflicts during construction and operation thereafter; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carisbad,
California, as follows that:
1. The above recitations are true and correct.
2. That the Interim City Manager is hereby authorized to enter into the attached
agreement entitled "Joint Use and Cooperation Agreement between City of

Carisbad, California and the San Diego County Water Authority" with the San Diego
County Water Authority.
PASSED, APPROVED AND ADOPTED at a Joint Special Meeting ofthe City Council ofthe
City of Carlsbad and the Carisbad Municipal Water District Board of Directors on the 3"^ day of
December 2013, by the following vote to wit:
